Yes, possibly - If he is a full-time student then you can claim him as a Dependent and as a Qualifying Child for tax credits. If he is not a full-time student for at least 5 months of the year, you can still claim him as a Dependent if you provide more than half of his support and his gross income is less than the exemption amount ($3400 for 2007). But you won't be able to claim him for any child credits.

bostonianinmo
If he's a full-time student for at least 5 months out of the year, lived with you for at least half of the year except temporary absences for school, hospitalization or vacations, and does not provide more than half of his own support, you may claim him as a dependent under the Qualifying Child rule.

Judy1
If he was a full time student for some part of at least 5 months of 2007, and didn't provide over half of his own support for the year, then you can claim him.

To answer your question with piece of mind, go to
www.irs.gov. If you don't see your answer in FAQ. then ask them directly and they will tell you. Doesn't cost you anything. They will even do your taxes.

Hamid
Yes. as long as does not have other income or full time job
