If you file jointly then you won't get what's owed to you. File separately if you want your money.
Of course the big question is why isn't he paying his child support?

You'd probably be ahead to file seperately. If you pay to have it done, they can figure it both ways, and tell you which way is best.

My advice is to file seperatly, like your split up. you claim the kids (if any) and keep the taxes you get back. The least he claims the less he gets back, so he'll only have to pay alittle and ya'll still get money with yours.

IRS will likely take all of the indicated refund on a Joint income tax return, so you would probably not get any back. Wouldn't it be good for your spouse to pay the delinquent child support?

You have to file an Injured spouse claim. You can get the form at the post office or download it. It delays the return about 8 weeks and you can't do rapid refund.

You might not. I would highly suggest looking at filing separately. However, you will need to check with your state as to how the income gets split up. Most states allow you to claim your earnings and withholdings, others require you to split EVERYTHING down the center.
