The IRS will not tell you who claimed the dependant, but they can advise you on what to do.
You will have to file a paper return
you and the person who claimed the dependant will receive a letter stating that 2 people used the dependants social security number, They will ask that both partys submit proof of who was actually eligible to claim the dependant. This can include school records, Dr records, copy of a lease agreement acknowledging that the child lives at the address of record.
The IRS will make a determination of who actually qualifies to claim the dependant. The person who claimed the dependant will then owe back any refund they received in error plus interest and penalties. This also raise a red flag on that persons future tax returns for up to the next 10 years.
Calll the IRS at 1-800-829-1040
Respond to any correspondence from the IRS immediately to expedite your claim.
This will cause a delay in processing your return and your refund

Rob and Bostonian are giving you the right answers. The IRS is not allowed to tell you who claimed her, but they'll investigate and take care of it if two people claim the same dependent. You'll have to file your return on paper by mail, since an e-file would reject. If you are eligible to claim your daughter, go ahead and claim her.

You can't find out who did it. Privacy laws prevent them from telling you that.

You'll have to file a paper return. The IRS will contact both taxpayers and resolve the issue. You'll get the exemption and the other party will get a bill for the tax due.

The only person that could claim your daughter would be your spouseexspouse or her father. It is hard to say as you didn't give any details how you found out. The tax department should be able to help in this. So take your documents and proof that you are the legal gardian and your own indentification and go to your nearest tax office.

If, and only if, you meet the qulifications to claim your daughter, and the other person does not, then go ahead and file your taxes, then it will throw up a read flag to IRS, they will investigate, and find out

if you dont want to do that, just check out www.irs.com, and get the phone number to call, and ask them, they should be able to tell you about 3 to 4 weeks after this person filed there taxes
