 My ex owes back child support and students loans, so who gets his tax refund and stimulus package?

You have to pay federal tax on any inheritance over $2 million. In Pennsylvania, you have to pay state tax on your inheritance no matter the amount, except that the spouse of the deceased person is exempt from estate tax.

Are you asking about the property tax or inheritance tax? Property tax, you have to pay. Inheritance tax depends on the fair market value of the farm at the time this someone died. There are several tax issues to be considered such as basis of the property and exemption from inheritance tax. It is well advised that you seek tax professional (CPA specializes in taxation) or tax attorney.

Until the proper papers have been completed to transfer the property to you, no you don't have to pay the taxes. That will be the responsibility of the estate of the deceased, but as soon as your name and signature are on the deed, you are responsible for all taxes associated with the property except back taxes if there are any.

If the estate doesn't have enough funds to cover the taxes, if may be turned over to be sold for the taxes and you'll lose out.

If you don't want the property, you'll be in better standing if you go ahead and sign the papers making your ownership official and then turn around and sell it. At least you'll get some money out of the deal.

No, you have to pay the taxes enough to keep the county from taking possession of it. It it looks terrible, they may not want to take it, so making it look bad could be your benefit if you need time to get taxes paid. Another option is taking out a mortgage to pay the taxes, then setting up lots of greenhouses and growing that ribbed french cantaloupe that looks like ours. It isn't just the state taxes. You will have to pay an inheritance tax to the federal government. The same tax that Bush wants to do away with but Obama swore to reinstate. It will be somewhere in the neighborhood of 40 to 50% of the governments opinion of the value of the farm. That is why so many family farms have been going out of business over the last 15 years or so. Clinton started the inheritance tax and it is killing family owned businesses and farms. The farms are usually confiscated and sold at auction to cover the taxes. Unless you have enough cash to pay up.
