If someone dies and has not filed tax returns that are due then the personal rep or executor for the estate is required to file tax returns for that person. |

Oh believe me, the IRS will let you know if that person owed money. The only "accurate" records kept over an entire lifetime are tax records. |

the IRS may want what is owed to them from this person's estate. I would talk to an Income tax attorney to get the answer that you need. You only have to file if you owe the IRS money, so if this person didn't owe anything then everything should be fine.

I would guess the only way around not filing is if the person was on Welfare or ADC.
I lost a very close relative years ago and had to file a "final return" for the year of their death. I hired a CPA to do it.
Dont wait around because if a tax is owed the IRS will penalize the estate. Also, My relative had been told by the IRS they owed some money (I found a letter in the house) I ended up paying it because they add penalities and interest. You may need an attorney and CPA

If they owe taxes the answer is yes. It will not become the families responsibility to pay the tax but it is the responsibility of the estate to pay the tax owed. One way or another if the IRS is owed money they will get it! If the person has any assets that they can attach they will. If the person has nothing than they can't get the moneyfrom the family. |

nope because they are dead my brother has been dead for over 13 yrs and the first yr of his not being here on earth the IRS didn't say he neede to file they had a ccurate account of his death . because family make the right phone calls and its the job of the government to delete these dead ppl out of the file.. the only ppl whom contacted us was the Texas Dept. of Public Safety its becuase he got a ticket 2yrs before his death and didn't pay it... so he had a warrant and it was funny to us it helped us laugh through the greif it was like he(my brother) always leave..something undone... so you don't have to fil taxes just call the right government officials |
