For 2007, the person would file as single. Your status as of 12/31 of the tax year. The only way you could file as married is if you had gotten remarried, to your ex or to someone else, by 12/31. |

If you have children and provide a home for the child or a room where the child comes on a regular basis to visit you, you CAN claim HEAD OF HOUSEHOLD even if you do NOT claim the child as a dependent on your tax return.... (EXAMPLE----the wife has physical custody but you have your child with you 50% of the time or 40% of the time and have a room for the child in your new residence, AND, although you pay child support to the EX for this child, SHE gets to claim the child as a dependent on HER income tax return.... you therefore can file HEAD OF HOUSEHOLD... however, with NO Children, you MUST file SINGLE. |

I believe you can file as a married person for the 2007 tax year, because you were married during part of 2007. Best to ask someone who prepares taxes, like H & R Block. They won't charge you for a question like that. |
