For 2007, the person would file as single. Your status as of 12/31 of the tax year. The only way you could file as married is if you had gotten remarried, to your ex or to someone else, by 12/31.

Your marital status on Dec 31st determines your filing status for the entire year. If you divorced at any time in 2007, your marital status is Single unless you qualify for Head of Household.

OK, you were divorced as of 12/31/07.
So you file Single, or if you have children HOH.
NOT married for tax purposes.

If you have children and provide a home for the child or a room where the child comes on a regular basis to visit you, you CAN claim HEAD OF HOUSEHOLD even if you do NOT claim the child as a dependent on your tax return.... (EXAMPLE----the wife has physical custody but you have your child with you 50% of the time or 40% of the time and have a room for the child in your new residence, AND, although you pay child support to the EX for this child, SHE gets to claim the child as a dependent on HER income tax return.... you therefore can file HEAD OF HOUSEHOLD... however, with NO Children, you MUST file SINGLE.

I believe you can file as a married person for the 2007 tax year, because you were married during part of 2007. Best to ask someone who prepares taxes, like H & R Block. They won't charge you for a question like that.
