Yes. It would take awhile though.
It has to go to the division of the court that handles child support and be processed and forwarded.
If the other parent is receiving "benefits" from the state. The state can recover the check rather than the parent. |

Yes, but perhaps not all of it. If the liable party files jointly, their spouse may file an Injured Spouse claim which will split the stimulus payment. In any event, it usually take several months for the money to show up. |

I would say yes because if it is court ordered and the parent that owes back money is supposed to get a tax-refund it goes to the other parent...I dont see why it would be different for this. |

If the child support enforcement agency submitted the debt to FMS for collection, yes. Normally there must be more than $500 in unpaid child support in arrears before FMS will accept the request for the offset. If the recipient parent is on TANF, that drops to $150 and the rebate (or any refunds) would be sent to the state first to offset the TANF. If anything was left after TANF was paid off, the recipient parent would get the balance from the state.
If the rebate is greater than the amount owed, the parent owing the support will receive whatever is left of their rebate once the debt is paid. |

the Custodial guardian recieves the stimulus check for the children. It takes court action for child support to take your tax refunds. |

Nope it will go towards the state the support is in.
After this happened to me I contacted the child support office and asked them about it. |

Well the parent that claims him on their taxes will recieve the refund. Also if you owe to the gov they will that it out of your stimulant check. |
