If two sisters are purchasing a home and both have dependents, can they each file as head of household?

Suzy Cutes
Yes, for each of their own families. "Household" mean family unit, not the number of people or families living in a house. As each of them has their own dependents, each sister is the head of their individual household. As far as the tax benefits for the mortgage, they either split it, or the "household" with the higher income claims it.

you know, I know of this two ladies who rent bendrooms in a house. They didnt even know eachother when moved in together. The owner just collects 750 rent from each. Each women has a child and pays all their personal household needs. The owner who lives in the front house pays all the property tax, water, electricity, etc...

They have no idea how much the other spends in food, shampoo, etc...

I do know that each always files as head of household and they use the same address.

will one be disalowed? i think not.

Franco
Yes. House ownership has no bearing on the matter. If you have different sets of dependents, you are heads of different households

Yes they can. Each is the head of their own household. The physical residence has nothing to do with it.

I believe both sisters can file as Head Of Household on there income tax returns. This was not always the case but I am pretty sure this law changed 3 or 4 years ago. My advise is to have the returns prepared by a tax professional and bring up this question with them.

You can also visit www.irs.gov for more information. Check out Publication 17, it good and has lots of information in plain english.

Head of Household filing status is limited to the person who pays MORE than half of the cost of maintaining the home. Two people CANNOT each pay more than half of the cost. Therefore only ONE of them can file as Head of Household.

Now, if the house is a two-family home and they each live in separate units in the home then they both CAN file as Head of Household. However it better be a TRUE two-family home as the IRS does investigate multiple claims of HoH filing status from the same physical address.

Not from the same house. Only one of you can. Who pays the most bills?

Remember, being the head of the household and filing as Head of Household (HOH) are not the same thing. There is only one HOH filing status per home. Check out the rules in IRS Pub 17.
