CCL | If you're comparing tax preparers, are you obligated to pay them? |
I wanted to see if another well-known company would come up with the same amount as I did by preparing them myself. I was a little bothered from the moment I called them, because they wouldn't even tell me how much I could be charged. They were rude, but also said that I did not have to pay if I disagreed. So, I went to see for myself. After he showed me what I would be getting back, I was so shocked to hear how much they charged and told him there was no way I could afford that. He said the fee was something we could have discussed before he started, but I said, "No--that's not what they told me on the phone; they wouldn't even give me an amount". My husband told me to just leave and have them put it on hold because we can finish them ourselves for a lot less. When I got home, I realized that they still have my W-2 forms and I need to get them back. I fear that they will be nasty with me when I tell them that I wish to take my business elsewhere. What do you think? |

Never use any professional that you are not comfortable in dealing with. This is also true with tax preparers.
You can go back to the store and pick your tax papers up sense they are your property. Some companies insist on you pay to pick them up, if that happen pitch a fit.
You should have asked up front to have the tax profession to view the tax return you did at home. I know H & R Block will go over anyones tax return free of charge.
Even if the tax preparer felt you have wasted his time, there is no reason why a prosfessional would treat you with anything but nicely. If they treat you nasty you do not want to be there anyway, so do what you need to do to get your papers back.

Ugh, as a preparer, I dread people like you and do my best to smell them out before I get too deep in. I liken what you did as to having someone mow your yard and you tell them its going to cost too much and they did a crappy job AFTER they did it.
These people are trying to make a living at what they do and you are trying to steal their time. |

Your W2s are your property. They must return them if you ask. If they hold them hostage, technically, you could call the police. |

They have to give you your W-2's back. Have you asked for them? From what you said in your question, it doesn't sound like you've even asked for them back.
They do not, of course, have to give you a copy of their work.
Depending on the laws where you live though, they very likely have the right to send you a bill and expect payment. You asked them to do the work for you. Don't you think it's a little unreasonable of you to expect a for-profit company to spend time working for you without getting paid anything for it, when they could be preparing someone else's tax in that time and getting paid for it? |

The only thing you did wrong was not telling them up front before they prepared your return that you wanted an estimate of tax preparation fees before you started. Instead, you let them prepare your return and then saw the price and balked. You should have told the preparer before he began to give you a quote. And no they cannot keep your W-2's legally. If you ask for them back, they have to give them to you. |

demand a certain amount of time to return them (i.e. a week), or threaten to report them to the better business bureau and the state attorney general. |

The last time I went they wanted $416 for 45 minutes work. I told them no way, picked up my W2s and haven't been back. |

If I was uncomfortable when I called, I would not have gone to the office. I won't do any business with anyone without a price up front. In your case, I doubt they figured your taxes without a signed agreement. I also doubt you read the agreement you signed. You are entitled to your W-2s, but you probably owe them the money. |

They can only charge you if you agree to file through them. I compared different companies one year and that's what I did. |

Don't waste the preparer's time. They're time is money. They could've helped out serious customers who have been waiting. Unless you are itemizing expenses expect the same everywhere. What a bozo!!!! |

The tax preparer knows damn well they ought to provide an estimate up front, and should be prepared to stick to it. Even if someone doesn't have enough (bad) experience under their belt, as you didn't, the professional could easily help you out here by discussing cost up front. Also, even if a professional realizes the cost might go over the quote once the process has started, they should certainly make you aware of that before proceeding. Go request your W-2 back, and do not ever give your business to someone who will not or 'can' not give an estimate up front. Someone in the office has definitely worked in that profession long enough to give a fairly accurate estimate. If that is not the case, you don't want them doing your taxes anyway. However, if you agreed to a price up front, you should expect to have to pay. |
