If you're getting a divorce during tax season how should you file?
My divorce will be final before tax season is over but I'm just not sure if it will be more beneficial for me to file while still married or to wait until the divorce is over. It won't make any difference at all on your 2007 tax return. Your marital status on Dec 31st determines your filing status for the entire year. Since you were married on Dec 31st, your choices are generally limited to Married Filing Jointly or Married Filing Separately.

However if you lived separately from your spouse for the entire last half of 2007 and paid more than half the cost of maintaining a household that was also the home for a qualifying person such as your dependent child then you may be able to file as Head of Household.

You'll normally pay the least amount of total taxes by filing a joint return, assuming that you can agree do to so. A joint return is ALWAYS an option as long as you are married as of Dec 31st of the tax year.

If you are married as of 12/31/2007 you would either file married filing jointly, married filing separtely or head of household if you qualify.

You will lose a lot of credits if you file married filing separately

Generally, your filing status will be whatever your legal marital status was as of December 31 of the tax year you are filing for.

In other words, since you were legally still married as of December 31, 2007, you can file married or married filing separately.

If you are on good terms with you soon to be ex, discuss this with him/her and find out what will work best for the two of you combined.

You are not single until your divorce is final. Married Filing Separately is the least desirable filing status to use.

You can fill out both tax forms and see how they look. If it is a better outcome to file jointly then go that route. But be sure your spouse is not going to be jerk and take all the refund.

Otherwise file separately

Your marital status as of 12/31 of the year is controlling. So for 2007 your choices are MFS or MFJ if you were together during the year. MFJ is almost always better than MFS. You don't qualify as single for 2007. Unless you have children and you weren't together during last half of year, it's MFS or MFJ.

legally, you would have to file married filing seperately. this is what i had to do when i was going through the same situation.
