If you are 17 can your parents still claim you as a dependent on their tax return?

If you're under 18 and under their roof then yes... they can claim you up until your 21 if you stay in school and live with them

COCO
You bet, until you're 18. then if you go to college they can still claim you.

Legally you are still a child, so yes.

Ryan M
they can claim you up up until 23 if you are in college. at 17 you are still a minor

stephenweinstein
Usually. There are a few exceptions.

For example, no one, not even your parents, can claim you as a dependent if you are married and file a joint return with your spouse, unless that joint return is only a claim for refund and there would be no tax liability for either spouse on separate returns.

In most cases, they also cannot claim you if:
a. you provided over half your own support for the year.
b. you are not a U.S. citizen, U.S. resident alien, U.S. national (except in certain cases involving adoptions).
c. you had your own residence (this does not include rooms at boarding schools, college dorms, hospitals, jail, etc.), no longer lived with your parents, and were no longer a resident of any of their homes.
d. you were not a U.S. citizen, U.S. resident alien, U.S. national, or a resident of Canada or Mexico, for any part of the year.

However, there are exceptions to some of these rules.

yes they can until you reach the age of 18.

Yes, they can still claim you. They can also still claim you if you go to college and they're providing more than a certain percentage of your living expenses (like paying tuition, room and board, etc). It shouldn't be a big deal at 17. They get a nice chunk of tax money for claiming you, and it doesn't hurt you at all.

If you still live at home and they still support you then yes. If you are out on your own with your own income (you file taxes) then no.

The dependent rules were changes in 2005 and some people still have not adjusted to the new rules...

Some corrections to peoples answers -

If you are a full time student and did not provide more that half of your own support - then your parents can claim you as long as you are 23 or younger on December 31st of the tax year in question.

If you are 17 and provided more than half of your own support, then your parents cannot claim you.

If you make under the exemption amount ($3,400 in 2007) and your parents provide over half your support, then they can claim you if you are 21, 33 or 62!

Read IRS publication 501

Also, if you're in college they can still claim you as dependent on them because, well, you are.

Your parents can still claim you for alot longer than that... i think its if the person is a full time student college oir otherwise... there are some loop holes and they can't be working fulltime... they have to be a college student

Yes, until you are 18 and/or if you are in college. Ask a tax professional for more information if needed. But your parents can claim you until you are 21 if they support you and you are in college.

If you still live at home and do not pay room and board, yes, they can. They can, in fact, claim you until age 24 if you are a full time student. It does not vary state to state....this is the IRS we're talking about.

hamsterbabies
yes even older than 18 years old if you still live at home because you're usually under their medical insurance as well.
