If you are married, can either file their taxes as Head of Household?
Also, which is better to file...Jointly or Separately? My husband did not file for 2006 because the return said he'd get $ back but then it was rejected and said he owed about $1000...I would guess separately. Also I am the only one that can claim my daughter as he is not the real father and has no legal right to her...right?! Thanks in advance!

Whether you filed in 2006 has a lot to do with it. As a married couple you may have to suffer for his lack of filing. As for Head of household, only one of you can file as that. As for the child, he could claim her with your consent, but that would be iffy if he doesn't claim you as well. If the biological father is paying child support, HE has the right to claim her. Truth be told, you should talk to a tax expert, (which I am not) :(

If you file separately you will be disqualified from some deductions and pay a higher tax rate. Before you file get your husbands situation settled.

I've tried it every which way possible, adjusting the "partial ownership" of the house to match salaries, you name it.

Married filing jointly is always the best, other than two singles.

Welcome to the marriage tax.

In almost all cases, you will be better off filing jointly. You can run the numbers separately just to be sure.

But yes, only one of you gets to claim your daughter as a dependent - it doesn't really matter which one - other than who will benefit the most.

It would be better for you to file jointly and then file an injured spouse form on yourself that way you dont get any of your money that you made taken by the IRS for payment and you would still get the EIC. Or you could file head of household and put child is not a dependent but head of household qualifier. You still get EIC. Then your husband could file head of household and claim your daughter and put not eligible for EIC. That way he would have less taxable income. But its hard to tell since I don't know your guy's agi. It would be better to go with the first since he does owe the IRS money.

If you file jointly you will be responsible for his 06 debt (plus penalties) out of your refund or EIC (if eligible).

Of course! But it's usually the one who makes the most money and/or has health benifets for both husband and wife. You are better off filing jointly so you can both claim your daughter as dependent.
