Really need to check your employee handbook. It will tell you exactly how they look at it. Most places consider 3 days of No Call No Show Job Abandonment (AKA you quit) which means you are not eligible for unemployment. You must be let go or fired for unemployment. Is there anyone above his boss he can speak with about the problems? |

Unemployment benefits are supposed to compensate people who are terminated for circumstances beyond their control. Your boyfriend is totally in control here. Sounds like you want the rest of us taxpayers to pay him for quitting his job? How nice of you. |

If you're fired "with cause", for example not showing up for work, then you probably won't get unemployment benefits. How about your boyfriend just find another job? Then he can quit and move on to better things. I |

If you quit or are fired for cause, then you can't get unemployment. Not showing up for work would fall into one of those categories, so no, he wouldn't qualify for unemployment comp.
He should look for another job, then quit his present one after he finds a satisfactory replacement job. |

It could go either way, but it's a moot point, really.
If you quit without cause you won't be eligible for unemployment benefits. A miserable boss isn't seen as justifiable reason for quitting unless his actions are illegal.
If you are fired for failing to show for work, your are being discharged for cause and are ineligible for unemployment benefits. |

Most places I've worked state in the employee handbook that 3 consecutive "no call, no shows" are considered 'voluntary termination'. That essentially means you quit. The rules for unemployment benefits vary form state to state. in many cases, even if you were 'fired' for not showing up, you would not be eligible for unemployment. It counts as being 'fired for cause'. If it were up to me, neither of your 'options' would be eligible. |

if he were to quit - he would not qualify. BUT- if his boss were to lay him off- that's a whole different ball of wax! |

Most employers would consider that a voluntary resignation if he doesnt call and no shows. that would not qualify for unemployment benifits. he would have to be fired directly by his boss. |

Not showing up for work for three days is considered job abandonment...the same as quitting. Why doesn't your boyfriend stay with the job until he can find something else, rather than try to draw employment welfare? |

It depends on how your state is with un-employment.
Usually not showing up to your job is considered Job Abandonment. (Its quiting with out notice)
Don't expect to be able to use the job as a reference.
Tell your boyfriend to do the manly thing, and give his notice. Just don't show up, come on. He can obviously work since hes been doing it for 7 years, he doesnt need to go on un-employment.
Have him look for a job, and give his notice to the current one he has. |

This all depends on what state your in and what kind of employment agreement, if any, he has with his employer...................I live in Florida and it's a right to work state which means we can't be forced into a union governed employment contracts.......Even so , if you don't show up for work in Florida it is considered a voluntary termination -meaning -you quit. And usually when you quit ....they don't reward you with unemployment. However the state you live in decides in the end , not your employer. You can be awarded unemployment if you get fired . Again it depends on the your state laws. Florida requires progressive discipline for some reasons an employer might fire someone . I was laid off a few years ago ....and believe me you can't live on what you get , anyway. Tell your Bf to find better job then quit. And good luck! |

He has to be fired in order to qualify. Not showing up is basically quitting.
He could do a no show but that would sully his employment record. Sorry to hear he is in such a tough spot. |

You don't qualify for EI if you quit or get fired, only if you get laid off.
Why doesn't he just give in his two weeks and leave? If he doesn't get laid of, the EI will never happen! |

To answer your question, it would be defined as quitting. But it really doe's not matter since you are not eligible for unemployment either way. |
