I filed married but separate when I left in 8/2004 but was not finalized until 3/2005. Talk to your tax person because it may be in both of your best interest to file together for that last year.

You have a few choices. You can file Married filing separately, married filing jointly (if you both agree.). If you have children and have been separated for more than 6 months, you can also file as head of household.

Separate or Joint, your choice. If you and the ex are on civil terms, figure it both ways before making a decision. It is normally better to file jointly.

IRS looks at your marital status on 12/31 so you are still married. Taxwise, MFJ will be the best for both of you. But it may not be practical depending on your situation. You should consider hiring a tax professional this year to help you through the transition.

You can file MFS (Married filing Separately) but this is the highest tax rate with fewest perks, and if one person Itemizes, the other must also itemize. If one individual has a lot of receipts to itemize and the other has very little, the latter will get screwed.

You can continue to file MFJ (Married filining Jointly) for best tax benefits, but you are both responsible for the entire tax, so you will have to agree on how to split any tax due or any tax refund. For fairness, I would recommend reviewing what your individual tax responsibilities would be if each of you were able to file Single. Then take those figures into consideration when determining the percentage of tax that each of you pay. Or you can also look at the percentage of your income. If you made 60% of the income, I'd say you pay 60% of the tax. If you can find a fair resolution, you will both save money.

Lastly, there is an exception where you can file HH-Married (Head of Household) if all of the following apply:
You lived apart from spouse for the LAST 6 months of the year AND you have a dependent child who lived with you at least 6 months (some exceptions regarding this part) AND you paid more than half of household costs for the dependent child. For these purposes, household costs include rent, mortgage interest, real estate taxes, home insurance, repairs, utilities, and food eaten in the home. They do not include the cost of clothing, education, medical treatment, vacations, life insurance, or transportation.

Yep! Married filing separate. Go to a an accountant your first year because if there is any type of audit, they will back you up...since audits generally don't happen until much later.

The marriage status per your taxes is through December 31st of that year, so if your divorce isn't til '08, then your '07 tax filing options are married filed jointly or married filed separately. In almost all cases it's better tax wise to file jointly primarily because if one of couple itemizes, the other can't take the standard deduction.
