 If one was not employed but a full time student with a dependant, are you able to still do taxes?

If you have a child for 7 months and his dad had him for 5 months who can file him as a dependent on taxes?
i have legal custody of him at this point also i will be filing soon if his dad tries to file after I do will the form be rejected or what will happen.He is 360 behind on child support and I think he will try to catch up his child support with the tax money

You have legal custody, it's your right to file, especially if he's behind on payments (Attorney Generals office can help you on that). Tax forms want to know if a child lived with you for at least six months. If he files before, after, or at the same time, he will need to possibly prove he is eligible to claim child, I would advise him not to try to fool them. Claim what's yours. Best to you!

The custodial parent is the one who gets to claim the child on their taxes. If both of you claim the child, the IRS will investigate, will give the exemption to the parent who's entitled to it, and if necessary will take steps to collect any overpayment that may have been given to the other parent.

It's to your benefit to file first, because then you'll get your refund before the IRS realizes there's a problem. Try to get your taxes done as soon as possible this year.

The parent who had him the larger part of the year can claim him. It's not who had legal custody, but who the child actually lived with.

I know in the state of Texas the parent that has full custody has the right to claim the child and get a return for that child. Usually their are some sort of court papers drawn up that will give a detailed list of whats and what nots. If you have had the child for over half of the year you are entitled to claim that child, if he tries that will be something he is going to have to take up with the IRS. You might actually talk to a person who does income tax returns to get a better more definate answer being they deal with that sort of stuff all the time. Cheers
