If you knew someone who bragged about not reporting all their income to the IRS, would you report them?
A co-worker of mine makes a decent salary and her husband, who is self-employed, makes a very good salary. They have a huge house, a boat, several cars, condo, etc. She is constantly scamming 'the system', whether it's complaining about a bad experience at a restaurant (just to get a free meal) or returning defective merchandise that she broke or damaged and claiming it wasn't her fault. I don't know how she gets away with it, but she does. She's bragged that she and her husband don't claim all their income on their tax returns, so they end up paying less than they should in taxes each year. This is just one more example of her constant scamming. I know, some people might think I'm jealous, but I really am not. I have a beautiful home, a loving husband and a great life. It just bothers me to know that this woman has so much and yet engages in exploitation every chance she gets. So, based on this brief description, would you feel compelled to report this person to the IRS for tax fraud? Thank you.

This is normally where I'd point out that whatever those people have, they're probably miserable and they'll eventually collapse under their own greed. I mean, all that energy they spend in trying to get out of paying for a damn meal could go into actually enjoying the damn meal. I know it sounds cornball, but it's really just simple balance, input equals output, and matter and energy are never created or destroyed. We'll all be sitting around with our bills and wishlists, but deep down, and in the long run, we'll really be happy for it. Meanwhile, they'll be sitting in their Porsches and mansions drinking fine champagne trying to stave off the knowledge that they will die someday and all anyone will remember them for is being greedy jerks who will never be loved or respected for anything past their olympic-size pool.

But, if I saw all this going down, I'd report them in a heartbeat. Even if nothing comes of it, they'll probably spend even more energy in trying to fight the system (auditors are persistent), and that could probably put a strain on their marriage and personal lives. Sounds spiteful, I know, but think of it this way: you'll be helping them. They might even thank you for it... even if it's from inside their cardboard box under the freeway.

No, because hearsay is not EVIDENCE of any criminal action. The IRS does not act on hearsay.

The odds of a small business being audited in any one year is about 10%. It's highly likely that they're already on the IRS radar for an audit -- if not now, in the near future.

I know a few folks who do the same thing, but also know that they report all income and pay their taxes as I do their tax returns.

Did you know that you could actually get a reward for reporting them? But, that is beside the point.

Think of it this way. Your are willing to pay your share and because they are illegally not paying their share it makes your share more. This is not only true in taxes. For every meal that they don't pay for, you help pay for every time you go to eat at the same place.

I am an enrolled agent...and I work very hard to insure that my clients do not pay a penny more than they are legally required. It is one thing to do it through tax planning and a totally different matter to accomplish it through fraud.

I am compelled by law to report situations like this one. However, I felt it was wrong before I became an enrolled agent. So, I had no problem with that clause.

Something else to think about, it is possible that this person is actually filing a legal tax return. But, then claiming otherwise to try to get attention (i.e. they are so smart that they know how to cheat on their taxes and get away with it). I mean if I ever did cheat I'm not going to be telling anyone else...that is how you get caught.

As a bookkeeper, I'm ethically bound to say yes. As a taxpayer, I'm sickened that I have to pay A**LOADS of taxes to make up for her scamming. IRS.gov.

For someone I knew for a relatively small amount, I wouldn't report them. For this case you describe, I'd at least consider it......
