If you let someone claim your children on a tax return,who gets the stimulis check for the child tax part?
I feel like in the middle of a war zone.My two friends made a deal with their tax return. Now they are at each others throat about who entitled to the stimulus check.Please some friendly advice.Also I told them not to make the deal in the first place.

The person who has the right to claim, takes care of the children 70% of the time. IF they do not have the rights, the IRS will want the money back.

Making deals with dependents on a tax return is not exactly in line with tax law... there are specific tests to determine who is entitled to the dependent exemption.... however, the one that claimed the dependent is stating to IRS they are entitled to the exemption, so if the child is under 17 (also qualified for the $1000 tax credit- who got that?) they would be also entitled to receive the $300 stimulus check.

Scenario 1.
Divorced or separated parents. Custodial parent allows non-custodial parent to claim children. On rebate based on 2007 tax return, non-custodial parent gets check. On tax return 2008, custodial parent can again claim the children and may get the $300 again. This is legal.

Scenario 2.
Custodial parent lives with another relative, say grandma. Grandma claims the children for everything. Grandma gets the check. On tax return 2008, custodial parent can again claim the children and may get the $300 again. This is legal.

Scenario 3.
Custodial mom lives with boyfriend (who is *not* the dad). Mom doesn't work. Boyfriend supports her and her children. Boyfriend can claim all of them, but only as "qualifying relatives" (stupid title as they aren't relatives). He gets $3400 exemption for each, BUT DOES NOT QUALIFY for anything else, including the rebate. If he tries to claim HOH, the child tax credit and EIC, he has committed tax fraud. He can get banned from EIC for 2 years or 10 years depending on whether the IRS believes his story that he didn't know he couldn't claim them as nieces/nephews or foster children (that requires a legal placement!).

Scenario 4.
Custodial mom isn't filing, and "loans" children to a friend she did not live with. Friend files them as their own children (or says they are nieces/nephews), claiming HOH, child tax credit and EIC. BOTH have committed tax fraud. BOTH can be banned from the EIC program for 10 years. The IRS is going to ask for both birth certificates *and* proof of residency.

The stimulus payment is automatically processed using the information from the tax return you file. So the person who has filed and claimed the child on their tax form will receive the additional money for that child.

No one will get it. Only if they are related dependants then neither will get the stimulus.

Anyone can correct me if I am wrong but i asked this same question and this was the answer i was given by multiple people.

The check will go to the person who claimed the child. But since what they did was illegal cannot wait until the IRS audits them, Federal tax fraud, jail time, loss of child to child services, and those of us that pay our taxes fairly get some relief. Oh and by the way if you know of a federal fraud taking place, and do not report it, you do in fact become an accessory to the crime, and also can be held liable. Yes I know they where smart enough not to get caught, sounds like the same thing thought of by all those that are now in jail. Interesting history fact, No one could touch Al Capone, had the cops paid for, the judges, the politicians, he finally went down for you guessed it tax fraud.

who ever filed will get the check and if anything fishy is going on there could be problems with the IRS and they may want their money back, and/or some jail time.

Whoever claimed the dependent exemptions is entitled to the up to $300. If they were smart, they would just split the money. It is supposed to be for the kids anyway.

You can't let someone claim your children on their tax refund. Anyways, they can fight all they want but the person who claimed the children will get the additional money

I am in a situation and dont know who to handle it, well i do but dont know the in's and out's. I was divorced in Dec. 12 2009, the children reside with me i support them 100%, he does send child support for them but he has not been in their presence since 2007, he has now filed his taxes and claimed the kids on his taxes, I went to file mine and it got denied. Is this tax fraud, since he falsified information on his tax return? Cant he get penalized for this behaviour?
