I don't believe that the laws have changed since the time that I was in arrears, and owed back child support. Based upon experience, I will answer as such.
A person in arrears of child support or alimony can voluntarily petition the Friend of the Court to have their paychecks sequestered. This means that a certain amount of the arrearages, plus the regular weekly or monthly payment will be deducted from each paycheck until fulfillment of the obligation. Remember that "voluntarily" is the key word here. Any monetary windfalls, such as Income Tax refund, sale of personal property, winnings from gambling (Lottery, for example), etc. cannot be taken from you UNLESS a court order states as such. If you are not legally compelled to do so, the stimulus rebate you will receive cannot be taken from you without being contested by the person to whom the debt is owed. If you are still unsure of the legalities of this issue, do some research, and check with someone that specializes in this area. Hope this helps you in some respect.

It will be applied but you can file form 8379 to stop this if you are a spouse of someone who owes. It's called injured spouse. You can get the form off the IRS website and you can file the form seperate from the tax froms you probably have already mailed in.

To the one who said deadbeats don't get them. You are very rude and you make yourself no better then a deadbeat by judging this person and leaving an answer like that, they didn't ask for your opinion

The rebate will be applied to the back debt like any other refund.

No, it will be applied to the back support and you will get a letter in the mail stating it has been applied to the debt.

I don't think so, but it's depending on how much is owed. If it's more than $600, then most likely not.

Depends on how far behind. I think over 90 days and any gov't money can be withheld. But usually they have to provide you with a letter of notice and an opportunity to contest it before they can withhold.

That don't make sense to me. Why would the government give these checks out, and then find a way, to get them right back, you would think, that what ever you owe,that they would overlook that for now, and just let people enjoy them selves. I thought we were suppose to spend this money! to help boost the economy.
