Ry | If you owe the IRS on your 2006 tax return due to error, can you still get the stimulus check? |
My tax preparer forgot to include a W-2 from my husband's employment on our 2006 return. We got a letter saying we owe money so we amended our 2006 return and filed for 2007.We entered into an installment agreement but it hasn't been processed yet and the IRS says it will take 8-12 weeks. Will we get the economic stimulus check, for filing jointly with one qualifying child? Additional Details It was Jackson Hewitt, nuff said.I asked my question just to be sure of an answer I already suspected, but had to ask anyway.I thought there migh be a chance becuase my information is not processed yet so as far as they are concerned they said my balance right now is zero, even though I sent them a payment, and that was definitely taken. |

Who did your return? A private accountant?
If you owe more than the check then they will keep it. If not you should get the remaining balance.
That is true, if the IRS hasn't received the info that you owe money, because of a mess up on your taxes, then you should get the whole check. They will then take care of the balance when you file taxes next year. So, for your sake let's hope the Stimulus check goes out first. (Hopefully direct deposit)
My husband and i always use H&R Block. When we used Jackson Hewitt we filed to get it back in 3 days, to say the least 3 weeks later we still had not got our money. When we went to H&R Block we walked away with money. I know people talk badly about them but we have never had a problem with them and we have been going there for 7 years. The good thing about H&R Block is, when you file your taxes and they offer what is called "Peace of Mind". So if they mess up (for example the person missed a W-2) and you end up owing IRS or you got to much back, they have to cover the fee and you get to keep the money you have already received.
With what has happened, I wouldn't recommend going back there. Which I am sure you have already thought about.
Hope this helps....and Good Luck |

You probably won't get the stimulus check, it will probably be applied to what you owe from 2006. But depending on the timing of the paperwork, it might slip through. If it does though, you'd be wise to send most of it to them as a payment against your back taxes to keep from paying more interest and penalties. |

Probably not. As a rule, IRS will keep any money they owe you and apply it to your debt. Having said that I have seen it get by them once or twice.
No disrespect to you, but your question is silly: If you owed someone and you discovered something of theirs in your possession would you give it back before they had paid you?
Well, neither will IRS.
Also, you are paying interest and penalties on the underpaid tax. That would have been avoided if you looked over your return before signing it. If the preparer had missed entering a w-2 you would have caught it then. If you had forgotten to bring the w-2, you might have realized that the amount of income on the tax return was low and looked for it.
If neither of these apply, I suggest that you keep better track of your records. As I tell all my clients:
"PAY ATTENTION! It's YOUR money!" |

If you owe your stimulus check will be offset, BUT that is if your 2006 adjustments have been made by the time your refund is scheduled to be issued. When did you send in your amended return, has it been processed already, amended return take up to 12 weeks to be processed.
So if has posted to your account, you might get the rebate. |

You can still qualify, the question is, what you qualify for will be used for what you owe for 2006? Most likely yes. Anyone that qualifies for the stimulus payment, as long there is no back debt. ANd you do have a back debt that has not been paid for over a year. So, if your debt is greater than your stimulus check, you will not get a check because the IRS will tell you that they used the stimulus check to pay your back debt. :( The bright side of it is that part of that payment will not come out your pocket, but from the stimulus. |
