There's no federal law requiring pay for vacation, even if you have accrued it - vacation is a benefit, not an entitlement. There may be states where the law is different. |

Legally, no. Laws do not require a payout.
HOwever most companies do have payout rules written into their handbooks-- check with HR or read your employee handbook. Some do pay but only a percentage (often 50%). |

There is no law that vacation be given as a benefit, but if it is "accrued" and sits in a "balance" it must be paid at termination. It is clear that it is something that must be paid because the employer must account for the amount accrued as a liability in their financial systems. If there is any question I would contact your states department of labor (perhaps they have a website) and clarify this for your state. However, in all cases I have heard of vacation time that is accrued must be paid at termination (and at the same rate of pay the person was making at the time they terminated). |

It *completely* depends on what state you were working in. Things like this are governed by state law, not federal. (Well, unless you're working for the government, or under a federal contract, but in general ... the state laws are what you go by.) |
