Additional Details OK, now enough with the you should have paids, I was counting on the refund because I am behind on my mortgage and now going to enter foreclosure, maybe a little sympathy huh?

Try to hire your a neighborhood stay at home mother to watch your child for like $300 a month. That should help you out.
Have you taken all the credits and deductions you are entitled to? If you didn't you might get more back or pay off your debt quicker. As for your mortgage call them up ASAP. Do not wait. Call them and tell them your having a rough time and work out a payment plan until you can lower your expenses. Example cut off your cable/internet if you can for a few months. Stop eating fast food and dining out. Last but not least find cheaper babysitting. No where should charge $800 a month for daycare. If that is the cast one of you should quit your job and start a home daycare center. There are plenty of forums for moms and other community websites that you can find cheap babysitting. http://craigslist.com

It is used to pay YOUR obligations. You got a loan, got an education, agreed to pay, failed to pay, defaulted on your obligations. Now the IRS is helping you to honor your obligations. |

no, if you are in default of your student loans, it is written in the contract you signed that they would take your refund check. What you need to do is contact the student loan company and get your loan in a forbearnce or defirment. This will prevent them from taking it out next time.
Student loan companies will work with you. I know because I graduated in 1995 and this was the first year I started to pay them back. Never late, cause I did the defirment and forbearance.
Edit. On your mortgage, I don't know what bank you have but you do have some options there as well. Contact your bank, see if you can refinance or, do an interest only payment schedule. This may help you get on your feet. I feel your pain, I have been 5 months late on my house before and I was lucky enough to get into a payment program the bank offered.
Keep in mind, they don't want to forclose banks loose money that way. If you can afford your home (normally) see if you can work something out. Staying in contact with them in the #1 priority. If you don't stay in contact they won't work with you as much.
Keep your chin up. It will all work out. |

SORRY Brian but No they will take it but if they didn't send you a letter , you might be in luck for this year. but try to start paying on it on your paydays regardless how much you pay on it they HAVE to credit you IT"S A LAW in most states.Hope that helped..good luck |

As the others indicated, the answer is No.
Here's an idea for you to consider.....
If you increase your withholding allowances -- just slightly.... just by "1" --- the IRS will withhold less from each paycheck. That means that you won't be eligible for such a large refund -- but, it also means that there won't be any large tax refund for the IRS to take each year to pay off your obligations.
Plus, you'll have more take-home money in each paycheck to help meet your day-to-day expenses with.
But, that also means that you'll have to manage that money better -- an area that you (apparently) don't do very well in. You really should start getting help managing your money.
As for sympathy, you'll find little of that on this forum. (Always live within your means. There are no excuses.) |
