sadinne | If your accountant screws up on your taxes, then can he/she be held financially responsible? |
We received info today from the IRS that says we failed to report $11,000 in nonemployee income. We submitted it to our accountant but somewhere there has been a screw up. The IRS now says we owe an additional $4400! We don't have it. It wasn't our mistake- it was our accountant's. Does he hold some liability? |

BUGS ARE YUCKY is right, you are still the responsible party and the accountant is only acting as your agent. I don't think the accountant was acting in bad faith. Unfortuntately, it IS still your income that is being taxed. |

You had the income, you owe the tax even if the accountant forgot to report it. As noted in other comments, the consequences of his mistake are limited to any penalties and interest you owe as a result. You would have owed the tax amount even if he/she had prepared your return perfectly. |

You must pay the tax difference, but your tax preparer or his Errors and Omissions insurance will usually pay penalties and interest incurred due to his error. |

See Section 9100 of the IRS code.
It covers just such a contingency. Basically, under Sec. 9100, your accountant commits professional ritual suicide. |

Acountant has to pay any late fees or fines, but you are still responsible for paying the difference of the original mistake.
If you have "piece of mind insurance" through H&R Block or something similar. Then the accountant has to pay for it all. |

Not if you signed the tax forms. Some accountants offer a guarantee and will cover the cost of their mistake but they don't have to. |

If you signed the tax return you are responsible. |

No, because your signature on the return means that you have reviewed and agreed with what was prepared. Therefore, you are still held liable. Unless you can prove that the accountant is intended to commit fraud, then he/she will get penalized, but you are still liable for the difference. |
