nope. You have 2 choices -married filing joint and married filing separate. If the most important thing is your refund and receiving welfare, divorce him and file head of household and maybe receieve a big earned income credit, assuming you are, in fact, supporting yourself and not just living off someone else. |

If you are married, your only choices are married filing joint or married filing separate.
Married filing joint is almost always better.
If you did not live with your husband for the last six months of 2007 and pay for the cost of maintaining a home for you and a child that you can claim as a dependent, then you may qualify for Head of Household.
Those are your only choices. |

I assume you are currently married to a man who is not the father of your child of whom you speak. That situation has no bearing on how you file your taxes. You get to claim all your legal kids as dependents, assuming you qualify in terms of support provided.
Your recourse for any additional money is to claim child support from the father of the child in question. |

Are you living with your husband, or did you live with him at any time after June 30, 2007? If you did, then your filing choices are married filing separately, or a joint return.
If you didn't live with your husband at any time, even one night, after 6/30/07, and your baby lives with you and you provide over half of the cost of maintaining the home for that baby, then you might be able to file as head of household. |
