You have up to 3 years to file taxes (IRS). That is if you receive a refund or you owe. I believe you have 3 years for the State, but check your State to be sure. |

You don't have to file if they owe you money. You can file whenever you want and you'll still get the refund. I just filed for my gf for 2004 and she got back $400.
The only penalty is for failure to pay taxes, not failure to file. |

Yes. Penalties for late filing are based on the amount of tax due with the return. If you don't owe anything, there is no penalty. However, the longer you don't file, the longer the government gets to use your money without paying you any interest! |

Yes it is. The penalties for filing late are all based on a percentage of what you owe. So if you owe nothing the penalty is nothing. Of course you're letting the government use your money interest free so file that return!! |

Based on my understanding there is no penalty for filing after the deadline of you are due a refund. Furthermore, it makes more since to update your W4 so that your anticipated refund is small. You will be better off investing that money during the year instead of receiving a lump sum. |
