Im wondering if my b/f should claim BOTH kids for taxes this year, since he made more money.?

He is the father of the children, but we did not live together the whole year. He did make 13,000 and I made like 6,000. He can't claim head of household because he was living with his mom for a while. So should he claim one of both?

You are probably ahead for the two of you if he claims both. Next choice would be each of you claim one, and last choice you claim both. EIC will work out close to the same with him claiming both or each of you claiming one. He will get a little from the Additional Child Tax Credit, you won't. Income taxes will work out the same if he claims both or if you each claim one - you won't owe any income tax.

Not enough information in order to help you. Is he a father of your children? Usually yes, it does help if person with larger income claims the children. If you are living in the same household, only one of you can be a Head Of Household.

Personal exemption is 3400 per person. Plus a standard deduction of 5350 for a single person. So if your BF claims himself and 2 children he will be able to deduct 12,150 of taxable income.

Use this information with your own personal information and figure it out.

WHERE exactly where these children living? It sounds like they lived with you, not him.

If the 4 of you lived together for more than 6 months out of the year, the children can be qualifying children to both of you and yes, in that case you could each file single and claim one child for EIC.

If he did not live with the children for more than 6 months out of the year, but you did, then you can only allow him to claim 1 or both children IF YOU QUALIFY under the special rules for divorced/separated parents. (Between the two of you, you provide more than 6 months of custody during the year; between the two of you, you provide more than 1/2 of their support.) If you qualify, then you can sign form 8332 and give it to him. Any child care credit, EIC and eligibility for HOH stays with YOU.

If he's a non-custodial parent, he attaches the form 8332 to his tax return and can claim the exemption ($3400 less in income) and the child tax credit (up to $1000). The form 8332 does NOT entitle him to head of household status, child care credit or EIC.

Are they his kids??? Legally that is??? If not, I don't think he can claim them. If they are, then figure up your taxes, them claim the deductions all three ways, his, yours and both.

If you provide more then 50% of their supposrt I think you should claim then. Do you guys have an undersatnding of some sort? Keep in mind that you may be able to get EIC , use child care credit, additional child tax credit. etc. If you decideyou will split the EIC then it shouldnt matter. Don't forget that if he goes to file his taxes before you and claims both of them without your permission (viceversa) he will get the money and you will lose out. The process to get the money back is pretty time consuming and sometimes not possible.

Of course we understand but it should be without cheating, which costs everyone. Whoever provided more than 50% of the upkeep of a home for the children gets the deduction. OR whoever has physical custody if custody has been decided. If it was equal, there are special rules for that.

You should really do hard core internet research on this because it's so important.
