If there is a will but not a living trust,does it have to go to probate . There is something called a beneficiary deed that clearly state who the beneficiary is ,but it's still in the parents name. |

you probably need to contact a lawyer to determine just how the will is handled, if there are probate fees or not
then when the beneficiaries are awarded their inheritance there probably is no taxability, or at least until the end of the year, for fed, the state may have other ideas |

If the will is subject to probate there will be court fees. Depending upon how the assets were titled (living trust??) there may be no probate or fees due.
If the only asset that you are talking about is deeded property held jointly or subject to a life estate, there may be no fees and no probate required. |
