In any way, Can X-boyfriend claim me on His Federal Tax Form?
Lived together several years, parted 2002 as friends. For many reasons, he has continued to give me $ every month since parted (never over Fed gift amount per yr. Example: $12,000 is max for 2006-2007). Facts: not related; not living together, not even in same State; no children together; never married to each other; no business relationship; only time he legally claimed me as Dependent was when we did live together. I qualified under the 'exception rule' as living in same household as family member. He is now married and wife pushing to claim me on their taxes. While together, we did up a 'Living Together Agreement', signed and notorized it. He wants to continue to abide by it (it states he will give me this monthly $, no mention of taxes). He is middle-income; I am low-income. He has not claimed me since we split. Doesn't want to start, wife does. Will seek tax advisor help, but anyone have answer re tax situation? Both older folk, me older than him. Me: not married.

No, he can't under any circumstances. The only way to claim someone not related to you is if they lived with you ALL year, and you didn't. Giving you money, even if he gave you a million dollars a year, would not make you his dependent.

His wife needs to check this with any tax professional or with the IRS if she doesn't believe it. She's wrong, he can't claim you.

HOH requires a relative. Someone who can be claimed as a dependent only because they lived with them from 1/1 to 12/31 is not sufficient for HOH status.

footnote 7 on the HOH chart: A person who is your qualifying relative ONLY because he or she lived with you all year as a member of your household is NOT a qualifying person.

You do not live with the taxpayer. You are not related to the taxpayer.

Therefore, even if you have no income and he supports you, he cannot claim you as a dependent.

You can claim almost anyone, but if they are not closely related, they must live with you the entire year (1/1 - 12/31). As you did not live with them, they can not claim you.

Wow, that's the first time I ever heard that one. (You live and you learn.) In short, no I don't think that's possible. If he didn't take care of you for the last 6 months to a year (in the house), then, no.

No, you can only be claimed by a family member.. they can claim Head of Household if you lived with them (correction to the answer above mine) part of the year 2007, or more than 50% of the time, does not have to be consecutive months, providing most of the expenses. You say he claimed you as a dependent one time.. if he gets audited by the IRS, that was illegal and he will have to pay back that deductions taxable amount. Best Wishes!
