To claim them you have to provide more than 50% of their support and no one else can claim them. It sounds like someone else may have claimed them and there is a dispute. Did you pay their rent? Do you have receipts for that? That is what is going to determine who gets to claim the kids most likely. |

It doesn't sound like you are head of household. You may not even get to take them as dependents depending on who pays for how much of what. To be HH, you need to pay for the housing, and they have to be YOUR children and your dependents and they have to live with you. It doesn't sound like you make all or even most of the qualifications.

It sounds like you need to do some basic homework and read the IRS Publication 501 which goes over all the rules of who can claim who and what the rules are to claim head of household. |

Uh, no, your girlfriends kids don't qualify you to file as head of household unless they are your biological children. You don't get the child care credit for them either.
If your gf doesn't work, you might be able to legitimately claim the kids as dependents though, if you can show that you provided over half of their support. If she did work and earn very much, or if she filed a tax return, then they are HER qualifying children and you can't even claim them as dependents. |

The letter you got from the IRS is pretty much a formality. They give you the chance to prove that you are indeed eligible for everything you claimed, but unless you are the biological parent for these 2 children, you aren't going to pass most of the tests.
To get this much in a refund you claimed head of household, qualifying children, child tax credit and EIC. The problem is, unless these children are biologically yours or were legally placed with you as foster children, you don't qualify.
Starting in 2005, the IRS created a definition of "qualifying child" and only if you have one do you get all the good stuff.
There is a "qualifying relative" category that your girlfriend and children may fall into (stupid category since they aren't relatives by blood or marriage), but it only gets you the $3400 exemption. You can only claim the children this way if their mother *can't* claim them. To qualify, they had to live with you ALL year, your girlfriend had to have less than $3400 in income (plus not file except to get withholding back) and *you* have to prove that you provided more than half of everyone's support. Once your girlfriend couldn't claim her own exemption, her kids were up for grabs.
The *only* way to get HOH status is with a qualifying dependent. Again, if these children are not biologically yours, the only person you've mentioned is grandma. You'd have to be able to both claim grandma as a dependent *and* show that you paid for more than half of the bills. Since this is *her* house, I doubt you can do either.
If you pull out the tax return, what does it show for relationship? If it says stepchild, neice/nephew or foster child, you lied. The IRS knows it and the letter is a formality.
PS, when the dust settles, you will be barred from claiming EIC with children for 2 or 10 years. So even if you marry your girlfriend, you still wouldn't be eligible for EIC. |

If they live with you 12 months , you pay all the bills, the mother is not working, you pay rent, utilities all in your name and you included all their ss# on your tax form you should be able to declare them. If their father declares any child support for them you are not their sole support. And if the mother collects any welfare, SS, or any other unemployment benefits you are not eligible. |

MAY have underpaid? Shouldn't they be knowing for sure! The only thing I can tell U is go play 2752 as a Cash 4 # on a lotto ticket and play it straight for one dollar and box it for a dollar. You might win $5,400 or close (if your lotto pays like GA Lotto) and then you can pay the bill because looks like they are saying you owe $2,752. The IRS is do or don't/ you do owe or you don't owe. No MAYBE'S. |
