hi i been together with my girl for about 3 years now and though we're not married i'm helping her with her 2 kids and she has been claiming them as her dependents the last 2 years now. this year i want to claim them as mine because i made to much money and with no dependents i have to pay. if i get those 2 dependents i get about 4gs. is there any risk in claiming kids that are not mine? Sure you can claim them.And you also risk being denied the EIC credit for 10 years if you are caught.That means if you have children in that time you can't get the EIC credit for them.Simple terms...no big refund.
Oh yeah,they can put you in jail too.
So yeah,by all means...go ahead and commit fraud. |

unless you like prison, i would not suggest doing what you mentioned. they are in no way qualified dependents of yours according to the rules of the irs. you want to claim them? get married, cuz thats the only way its gonna be legal .
sidenote: even if you get married before you file this year, you still cant claim them til next year. |

See IRS Publication 501. Unless you are their father, you cannot claim them as "qualifying child" (no child tax credit), but they "might" meet the requirements for qualifying relative.
But what works out better overall for the two of you combined? Since they are "her" qualifying childred she could get her taxes reduced by at least $2000 more than you could, depending upon her income (even more if EIC applies). So trying to get yourself out of a bind with the IRS for under withholding could cost you either way. |

If you both claim them then you will have to repay all the money you got for them. If they qualify as her dependents then you cannot take them. |

Risks? At most, prosecution, fines and prison. At least, if you get caught, having to pay back what you got illegally, plus interest and penalties, plus being banned from the EIC progrram for up to 10 years if you claim EIC for them. And note that the IRS is really looking closely at EIC claims, since there is so much fraud there, so you have a good chance of getting caught. |

Yes, you can claim them as qualifying relative if you meet the requirements. Also the kids must not be qualifying child of your girl.

Yes you can... Glad to see us brothers taking care of some body's kids these days. As long as you provide I think don't quote it's 50 or 75 percent of there care in living expenses and they lived at a physical location with you. you'd be good to go. Hey I been meeting sista's with kids every day... And they are nice, but I want my own... ya know? |
