Inland revenue charging me unfairly, what to do?
I have been sent a £100 bill by the IR, followed by another £100 bill and this is because they say I have not sent my tax return to them. I sent it by recorded delivery but they said they did'nt get it. I went to the tax office and gave them a new copy but they still say the charge stands. I disagree. So what to do to resolve this?

Hi - they said that the slip proved it could just be a normal letter, and not the return. So I cannot prove what was in the package. It is such a mess and yet I feel I have done nothing wrong!

Take the Recorded delivery slip to the Tax office and ask them to show you what they removed from the envelope if it wasn't your tax return. Envelopes and their contents are usually kept together by government offices especially where a deadline date is in operation.
If no success, then write to the tax office again , with a copy to your local MP (make sure you put on your letter where any copies have been sent).

1st of if u did send it recorded delivery then u must have proof of sending it take tha t in to the linland revenue and show them your reciept

2nd u can always apeal but u may win or if u lose it could go 2 ways bill stands as it is or another increased bill

my advice is to choose 1st option good luck

The £100 penalties are because your Tax Return was sent in late. Only if HMRC had lost your return, they may drop the penalties. Proof of postage is not a proof of receipt. When your return is processed, if there is no tax to pay or HMRC owes you, the penalties will reduce to zero. If you have tax to pay, the penalties will stand but you can appeal against them in writing to your tax office. If HMRC does not agree with your appeal it will be sent before the Commissioners for them to make a decision. Worth a try, if you don't ask if you don't get.

As HMRC say, there is nothing to prove that it was your self assessment in the envelope you sent. You could take it to appeal before the Commissioners, but my guess is that there are lots of cases like this and it would be thrown out.

Firstly, you should have a receipt for recorded delivery. Secondly, you should ALWAYS keep a photo-copy of any documents so you can re-send them. Thirdly, send it by FAX or email, instead of post, if you are in any doubt about the reliability of the mail.

If you can show that you posted it, they must accept your word as to what was in the package. What else would you be sending to them?
Appeal. They will accept it.

if you sent it recorded.. go to post office and get a reciept saying that your package was delivered and signed for and take this down to your local tax office... If they still dont believe you, just tell them that you have consulted your financial advisor or solicitor about this and you are in the wrong....

If you sent it by recorded delivery you will have a unique number and you can confirm that the package was sent ..and probably received. Did you keep the receipt? If so you can check on the Royal Mail website link below.

Having proved the error is not yours you have a good chance to set the fine aside.
