My husband got a bill from the inland revenue as he has a cis card but has never used it as he works from a company and pays tax and ni through is wages. What sould he do about the letter. they have now sent a letter saying he owes another £100 as the payment is late. Additional Details We phoned they weren't very help, they said he had to see an accountant we don't have the money to see accountants to sort this out sometime i wonder why we bother working when you are working to only make ends meet and you ge hit with this shi* |

Because your husband did not return the self assessment it appears that he has been issued with a 'Revenue Determination' which is an estimate of the tax that a CIS contractor would owe. If he completes a self assessment form showing nil income from self employment and completes the 'employment' pages showing the tax and NI already paid through his employment, then this assessment will be reduced to nil and they will more than likely discharge the £100 fixed penalty fine.
Your husband probably got put through to a call handler who is reading from a script. Ring the telephone number on the bill and ask to be put through to the 'debt management team' who will be able to sort this out for your husband. Your husband does not need an accountant to represent him on this matter and I'm sorry that the person on the telephone misinformed him.

I would have rung them as soon as you got the first letter. The Inland Revenue is rubbish at communication both via phone and letter. They obviously have not been made aware that your husband is now employed as opposed to self employed. If they last had him down as self employed he will still be registered under this and i would imagine this is where the charges have come from. I shouldn't worry too mcuh as they have obviously made a mistake but i would contact them ASAP. |

What he mustn't do is ignore it.The fine of £100 is for not supplying a self assessment return. Did he get one to fill in and ignore it?Looks like some of this might be your husbands fault for not communicating properly with the Revenue people.Get in touch straight away and if necessary go to their office and get this straightened out. |

Notmarried is correct - only the completion of a self assessment will overturn this bill. The self assessment will also cancel the £100 fine.
He should also consider whether he wants to turn in his CIS card or else he will go through this every year.
Its just a matter of entering the pay and tax from his P60 on the form and signing it. Go to your local tax enquiry centre if you are not sure. |

Phone the number on the demand as soon as possible and tell them that all his earnings for 2005/06 were Schedule E. They will probably want him to complete a tax return confirming that and will then withdraw the demand and penalty |

This sounds to me that a self-assessment tax return has not been completed, and that the Revenue have raised a determination (estimate) of the tax that they think is due.
IT IS IMPORTANT THAT YOUR HUSBAMD SPEAKS TO THE REVENUE NOW.
I work in the debt management of the Revenue, so I know exactly what will and can happen.
Fengirl and Notmarried are correct, the only way to overule a determination is to submit the self-assessment tax returns, make sure you complete the employment pages, and give P60 details. When you have completed ALL the returns that have been sent to you then the likelihood is that your husband will be taken out of self-assessment and this will all stop.
However, if your husband is a director of a company then self-assessment will continue.
Talk to your nearest debt management office, their telephone number will be on the letters that have been sent.
What will happen if you ignore all this?
First off you will have a distraint officer knocking on your door. For distraint read baliff, they will list goods to the value of the debt and you will have 6 days to pay in full. If you do not then those goods listed will be removed and sold at public auction (no reserve prices) and the money recovered minus costs put to the debt. If this does not clear the debt then the matter goes to county court with a view to making your husband bankrupt.
At the same time the case can be refferred to the Comissioners of the Revenue for daily penalties, and this can be as much as £60.00 per day per return that is outstanding. So you can see that the debt can mount to astronomical proportions very quickly.
What can the debt management people do?
Nothing until the returns have been submitted, and the proper debt established. After that a time to pay can be negotiated, you may be required to give details of your income and expenditure, but a mutually agreed arrangement can be set up. So long as you keep to that arrangement eventually the debt will go away. You must while the arrangement is running keep all the tax affairs up to date, so if further liabilities become due they must be paid on time when they are due, and all tax returns submitted on time.
I know that this is a long answer, and some of it not pleasant to read, but it is what might happen, especially if you do not talk to the Revenue.

what you need to do is put it in writing to these people and explain to them that your husband is not self employed and that he works for someone and tell them how long he has worked for this company and would they be kind enough to stop sending you these bills as you have had enough tell them that you spoken to someone on the phone about this matter but obviously it has done no good that's why you are putting it in writing hoping it will stop and tell them if it does not stop that you are seeking legal advice and asking my solicitor to make you stop tell them hopefully you wont have to go that far and they will put a stop to it but if they don't it would have left you no alternative than to go to your solicitor and before you send this letter make sure you photo copy it and if i was you i would send the letter recorded delivery so they cant say they haven't received it i hope this will help good luck |
