You have to have the evidence to support entries on your tax return. If you can;t you are stuck with the bill. |

If the children are under 19 (or under 24 and attending school) and don't pay for their own support, then any relative living with them for at least 6 months who is not someone else's dependent can claim the children as "Qualifying Children", not "Qualifying Relatives" as another answerer mentioned. It does not matter who provides their support, only that they live with the children for at least 6 months, they are related (parent, uncle/aunt, grandparent) by blood or marriage, and the child doesn't provide over 1/2 of their own support.
You have every right to claim the children if you are their uncle and lived with them for at least 6 months. However, their mother also has the right to claim them if she lived with them for 6 months. If you both try to claim the child, the tiebreaker always goes with the parent. So, not only do you have to prove to the IRS that you lived with the children for at least 6 months during the year in question, but that the mother (who also claimed the child) did not live with the child for 6 months. Anything legal will do like sworn affidavits from teachers, ministers, neighbors, law enforcement personal, whatever. Of course, the mother will try to do the same thing. Ultimately, it doesn't matter what the truth is, all that matters is if you can convince the IRS. Regardless, if you can pay the IRS what they say you owe them, pay it now and continue fighting the case. If you lose, you will not owe any more interest. If you win, you'll get back your money with interest. |

What "papers"? The proof you'd need is that they lived with you (eg school records, statement from landlord or neighbors) not that you had legal custody. There are additional rules that you'd need to meet also.
Unless you can prove that you can legally claim them, you might as well just pay back the money and get it over with. |

In order to owe so much, it's fairly clear that the poster claimed them as "qualifying children," not as "qualifying relatives." QCs may have entitled him to head of household filing status (higher standard deduction), 2 extra exemptions as well as child tax credit, child care and EIC.
Because of the amount of money involved and so many people want that money that they will lie to get it, listing "neices" and "nephews" is a come-audit-me red flag.
You must be able prove to the IRS's satisfaction that you met the tests.
1. Relationship and Age. Through birth certificates you must prove these are the children of your brother or sister. Just because you call them nephews doesn't mean they are.
2. That they lived with you for more than 6 months. If they are younger than school age, you will be stuck unless you can produce other support such as paid child care, social service records, etc. If the mother took all these records, you need to get new copies.
3. You can't lose on a tie-breaker. If one of the parents lived with you with their children, the parent's claim is superior to yours.
4. If it's considered more than just a misunderstanding, you can be barred from the EIC program for 2 or 10 years.
Lastly, the preparer who did your taxes should have quizzed you on all of this and advised you to keep all paperwork in a safe place and ready to produce for the IRS.
If you kept these children long enough to try to claim them for 2 tax years, be advised that if you got audited and lost for year 1, you will be audited just as stringently for the 2nd year. |

If they lived you, you just have to prove it. School records with your address, doctor's bill's with your address, etc.
If they didn't live with you, shame on you. You have been caught and do owe them the $6000 you took that you shouldn't have. Plus interest and penalty. The sooner you pay, they better because the interest is adding up. |

Well, if your claim is legitimate, you should fight it. You get school enrollment records, any proofs that the boys lived with you.
The IRS is concerned because there have been so many fraudulent EIC claims. But they work with people when there are conflicting claims, as here. Apparently the boys mother or some one else also claimed them. You don't have to have their SS cards, but anything, any records showing they lived with you. If you bought them pool passes, enrolled them in afterschool tutoring or sports or anything. . . . .get copies of those records. You make a statement saying I am XXX Doe, and my nephews Joe VV Roe and Jon SS Roe lived with me from Jan.1, 2007 to and through December 31, 2007 (whatever the actual dates, use them). I enrolled them in my local school, took them to doctor for check ups, provided room and board for them throughout the year. (Use the facts from your situation). Then sign your name and send it to IRS along with notice they sent you. Get copies of anything you can and send with it. If your LL knows they were there, get a statement from LL.
Otherwise, talk to IRS and make a payment plan, and start paying them. |

Pay up! since you don't have any proof that the child you claimed was supported by you, lived with you etc.
If you can't pay all the amount at one time then visit IRS website: www.irs.gov and download Form 9465 Installment Agreement Request, the minimum payment IRS will accept for a $6K balance due is $100.00 per month, interest and penalties continue to accrue until you full pay the amount you owe, and any future refunds will be applied to the debt. IRS charges a USER FEE for installment agreements
$105.00 (you mail the monthly payment in) Direct Debit $52.00. this is a one time fee, if you default then to reinstate the Installment the fee is $45.

Nephew can be your dependent under Qualifying Relative only if you provided more than half of his support for the year and he did not earn more than $3400 in 2007.
