i received an cp2000 from the irs saying that there has been soon proposed changes to my 2007 form 1040 saying i may owe the an x amount of money. its not a bill from them. they want me to verify and reply by Jan. 21,2009. its also giving me options like if i agree that i owe pay all now or set up a payment plan or if i don't believe i owe fill it out and send it back to them by the 21st. what i really want to know if since this is not a bill yet, would i be able to get my refund when i file on Jan 16? Additional Details Thanks for all the answers I got so far. I will contact them. Hopefully I will still get my 2008 reund check. |

It will not affect your refund for 2008 at this time because IRS has not assessed your 2007 with the changes they found. Processing of CP2000 information takes tax examiners at least 6-8 weeks to process. IF you do owe when you reply to IRS you can include Form 9465 installment agreement and the minimum IRS will accept is $25 for balances up to $1.499.00, $50 for $1500.00 to 2999.00;
(or divide the amount you owe by 60 months and that is the minimum, but must be more than $25.00. ) IRS charges a one time user fee of $105.00 you mail the payment and $52.00 User fee you have it taken from you checking account.
Interest and penalties continue to accrue when you have an installment agreeement. |

The letter you received will have a listing of items reported to them on 1099 forms etc. and what you have reported on your return. If you agree that they are correct simply sign the letter and return it to them. If you have reported the items thay are showing send them a copy of the return and point out where them amounts have been reported.
If you respond timely tey willnot do anything to hold up your refund for 2008. |

A CP2000 letter is issued when you have under reported income. The most common reason is income reported on a 1099 or W-2 was not included on your tax return.
If you don't respond by the date in the notice the IRS will presume that you agree with their assessment and will start collection proceedings. If you submit your tax return and it is processed PRIOR to the date in the CP2000 letter you MIGHT get your refund. It will depend upon whether or not the IRS has put a hold on your account. If the amount of potential tax is significant, the IRS may have frozen your account until the issue is resolved. If they have, any refund from your 2008 tax return will be held until the issue is resolved. |

Yes, it's a timing issue.
However, you DO owe the money. So if you get your entire 2008 refund, don't be stupid and immediately spend it. Put the money you owe aside and send it back in marked 2007 cp2000.
It would foolhardy to not pay it and then offer to pay it back a little bit each month. You would pay a $105 fee AND about 10% more for interest and penalties. |

2. Check you tax return. Tell IRS if you agree to it or not. If you don't agree, you must have solid reason. If you agree, you must pay tax due with interest and penalty.
3. Do not try to delay things.

If you dispute the amount or do not pay the entire amount due they WILL NOT issue your 2008 refund on time.
You have not said if you owe the taxes or not but if you do and pay today there MAY be time to clear it before filing your taxes for a refund but likely it would NOT be cleared in time if you file early.
This is in the computers now and your return for 2008 will not be processed until this is taken care of.
Calling them will not change this period. |

They are just saying they disagree with something on your return and would like you to either prove that you are entitled to whatever they are questioning, or say you will pay the difference.
You should still be able to get your 2008 refund if you file before January 21.
But don't ignore the notice. If somebody else did your taxes that year, bring it to them. If you did your own, call the 800 number on there if you don't know what it means. |

If you have not paid what the letter claims you owe by January 16, even though a bill has not been presented, then almost certainly you will not receive your refund for your return filed on January 16 up to the amount in question.
Do you agree with the letter? Then indicate that on the reply part of the letter and mail it back to them with some payment if possible.
Do you not agree with the letter? Then reply in writing to the letter stating why the letter is in error. Even if the IRS agrees the letter was in error and you owe no additional tax, it takes about 45 days to work this out. Your refund will most likely be held up until this is settled. |
