Is claiming someone else's kids when I file taxes okay?
My boyfriend's sister has 3 kids and she wants me to claim one of them when I file my income tax this year. I don't know anything about how things work but some how she says she would get more money back this way. I don't mind helping her out, she needs all the help she can get! But I don't want to get into any kind of trouble. Is this a type of fraud? She would have my boyfriend claim one of her kids but he's already claiming 2 of his younger brothers (they have a huge family). Their scenario is that she doesn't work and her husband has worked only half of the year. Please give me any advice? Thanks in advance!

I'm just going to agree with what everyone else has said. It is indeed tax fraud, and I'm glad you asked the question instead of just going along with what your b/f wanted. Good luck to you in telling him and his family "no" - it isn't an easy thing to do, especially when money is involved.
She may need all the help she can get, but this wouldn't help her, really. I'm flat broke too, but doing somethng like this will only make it so one of you will owe the IRS when you get caught - in this case, it'll be you, even if you gave her the extra money. Doing this can also affect you for years to come, since the IRS can deny certain credits for up to 10 years if you have defrauded them in the past. Just think, 5 years from now you're married with kids, and can't get full credit for them because of something you did this year.

It most definitely is fraud, and you will be caught. You will be the one paying for it, not your boyfriend's sister. You can't simply claim someone else's children as your own for the purpose of getting money back. You have to provide birthdates, social security numbers and permanent addresses. You're nuts if you try this!

Out and out fraud, and with the IRS? Just because he only worked 1/2 year the more they can claim the better the return. Something is wrong here, more likely someone is trying to get you to fraud the system. My guess is he worked for cash and did not pay any taxes but wants to claim benefits. As stated something is wrong with this whole scenario, and as an honest tax payer I truly do hope all get caught. If caught As a note your boyfriend claiming 2 of his brothers is also fraud, it might take them a couple of years but they will be caught, then add the penalties, garnishment for payback etc, and possible jail time. Do you know how Al Capone finally ended up in jail? Not from racketeering, not from selling illegal booze, or mob operations, no from tax fraud. Just a thought

Yes it is fraud. You are not a legal parent or guardian of the child and CANNOT claim him as a dependent. The IRS will find out and they will come after YOU. Just don't do it. Your sister needs to learn how to take care of herself and her own children.

The first think I would do is to check out the prisons in your part of the country. If you have spend any time there for committing tax fraud, you will want to know what your options are.

Unless you are legally responsible for the child, you cannot legally claim him/her on your taxes. It's fraud and you don't want to get mixed up in it.

You need to find a new family and a boyfriend. This is just plain good old-fashioned fraud. I would like to sit in on the many IRS audits and just watch. Stay away from this illegal scheme and start looking for a new boyfriend.

That would be illegal, and you can get into major trouble since you'd be attempting to commit tax fraud. Your boyfriend might already be in trouble if he can't legally claim his younger brothers - that would be questionable.

Anyway, stay away from claiming those kids. It's illegal, and will just get you into trouble.

You cannot claim children that you are not financially responsible for. It is tax fraud. The IRS will reject your tax form and make you prove that these children are dependents of you and you exclusively and you are eligible to claim them as dependents. The IRS may want you to prove legal guardianship.

The only way you can legally claim these children is if they live in your home and you are financially supporting them (and your boyfriend's sister and her husband are not). If they do live in your home and you are financially supporting them, you may be able to claim them, but you will need to talk to a professional who will be able to process your forms correctly.

If they are not living in your household and you are not providing full financial support, you can get is serious trouble - tax fraud is a felony.

You can claim the child and say that you provided ALL childcare (babysitting) and that the mother did not pay you, and instead, you agreed to claim the child as payment. This is explainable to the IRS and has worked for my sister before.
