Is it illegal for an employer to NOT take federal tax out wages?
If an employer doesn't take federal tax out of an employee's wages, but does take out other things such as medicare, social security, etc. is that illegal?
Why would an employer do that?
From what I understand in that case the employee then has to pay the federal tax themselves come tax time. Is this true?

I am single, don't own a house and have no dependents.
I'm not a sub contractor. It's a really small business so there is no HR to talk to, I have to talk to my employer if I have any problems, and that tends to get awkward if I seem to be accusing them of doing something they shouldn't.

no its not illegal for them to do it...either way you are ending up paying it. the thing is that some people have that done because they do not make alot of money anyways and want to make sure they get it all. you are suppose to tell your employer how you want things taken out. you should have known they werent taking anything out. if they did it this year and you do not want it done next year, you need to make sure to talk to the appropriate people at work to get it taken care of.

Whether anything is taken out for income tax depends on what you put on your W-4. It sounds like they are taking out the other taxes that they are required to.

Yes, if nothing is taken out for income tax and you owe anything, then you'd have to pay it. You'd have paid it if it had been withheld from your paychecks - only the timing is changed, not who owes the tax or what you owe.

no, it is not illegal. it depends on the number of exemptions you listed on your w4. if also depends on the amount of money your are making---sometimes you may not be making enough to take out fed taxes depending on your exemptions.

Federal income tax withholdings are based upon your income and the marital status and number of allowances you claim on your Form W-4.

If your income is low enough or if you claim enough allowances it's entirely possible for no Federal income tax to be legally withheld from your pay.

For example, a married person earning $35,000 per year and filing a joint return with their non-working spouse and having 3 children under age 17 living at home can claim up to 12 withholding allowances on their Form W-4 and have no Federal income tax withheld yet still receive a refund of over $3,200 at filing time due to the impact of the Child Tax Credit, Additional Child Tax Credit, and Earned Income Credit.

There is nothing illegal about it. An employer can withhold medicare and social security taxes even they might not withhold Fed or state taxes. If you opted for exempt on your w-4 they will not take any taxes. If you will make under a certain amount of money they might not withhold taxes, but you are still responsible for them if you were required to pay them.

As far as I know it is the responsibility of the individual to report their earnings and pay their taxes. I don't believe it is illegal for an employer to allow you to have your whole check.

An employer is required by the Internal Revenue Code to withhold federal income from your wages based on your Form W4. It is possible that your Form W4 has more deductions on it that would allow you to not have any withholding. If you are having to send in a check every year with your return then check your W4 with your employer and reduce the number of exemptions you are claiming.

The Internal Revenue Code are the tax laws passed by congress. So if your Form W4 reflects that you should have withholding and the employer is not withholding it and/or not making the payments to the IRS they are breaking the law.

If your W4 is correct, write to the IRS and provide them with the employers name and address and a description of the problem. Mail the letter to the same IRS Campus that you file your return. The addresses can also be found at www.irs.gov

It is not illegal and there may be a amount you have to earn before they will take it out. My son works thru his college at a Veteran's Home and they (the college) only took taxes out of one pay stub in 2007, as he went over their cap for doing so. They claim they do it so the student has more of their own money to spend, but it also kind of screws you over at the end of the year. He didn't owe, but he didn't get nearly as much back as he'd hoped, and that was only because he worked in a fast food place last summer that he got anything back. If you want taxes withheld or want to know why your employer is not, ask your personnel person.

No, however this does not preclude the liability for the tax. If you are a w-2 employee your wage information is went into the IRS. If you are a 1099 " employee" you would be responsible for the full fica contribution of over 15%.

Some employers may want you to be a considered a "subcontractor" since it saves them on the employer portion of the social security and medicare ( fica ) payments, however, this could be illegal for them if you are really an employee.

The amount withheld for federal income tax is not up to the employer. Depending on the amount of (1) money that the employee is paid, and (2) allowances that the person claimed on the W-4 form, the employer may not even be permitted to withhold income tax.

If you want, you MAY elect to give your employer a new W-4 claiming fewer (or zero) allowances. This MAY result in federal income tax being withheld.

Do other employees have federal withholding taken from their checks? Is there state withholding being deducted?

Did you fill out a W-4 when you were hired? If you filled one out and they are not taking tax out, it may mean you are in a low enough tax bracket that there is no tax to withhold. Or you claimed too many exemptions and as a result when they calculate the withholdings, there is nothing to take out.

Do they use a computer or a payroll service to calculate the checks? Then they probably are taking out what they should be based on your W-4 - which could be filled out incorrectly, if you think you owe taxes.

Are the check written out by hand? Then they may not be withholding on purpose.

Talk to your tax preparer and ask them for help as to how much tax you should be paying per paycheck.

Actually, you're referring to contracted employment. It isn't illegal for the employer to not take out the taxes. As a contractor, you're responsible to pay your taxes quarterly. I would suggest help from an accountant, or possibly referring to the IRS website.

It may be an oversight and you should go to the human resources person to get it straightened out.

It is not illegal but if you don't have your employer deduct the tax, you may have to submit quarterly tax payments on your own. You would have to figure out what the amounts would be based on your earnings by visiting the irs website, the library for publications on the most recent rates or contact an accountant to help you with the exact figures. It can be very confusing and there is a risk of errors resulting in a large lump tax payment at tax time.

Yes, it is unless you are an independent subcontractor in which case you would need to report your own income separately. Your employer has a Tax ID # and that is for withholding employees taxes and they must file a quarterly report, that is why you fill out a W-4 form. They can get into a lot of hot water if they do not report. These other answers saying it's your problem have never owned a business nor do they have a clue. Good luck.

You are correct that you and the employer will eventually have to pay federal tax! If a tax is not taken out of your regular pay check then it will show up when you do you taxes at the end of the year. However, I have a couple employees that claim enough dependents that they don't have any taxes taken out of their check. You might just want to check to see if human resources has your information down correctly or change the number of dependents that you claim (fewer dependents more taxes taken out).

It may not be the best business practice but I've never seen where it is technically "illegal". Why would an employer do that? He may not have enough money right now to pay his portion of the tax so is waiting until the end of the year to pay it in one lump sum. Or it could simply be a glitch in his payroll personnel.
