My employer wants me to go from being a 1099 employee to a W-2.
He is dramatically lowering my base salary.
I am single, 39 yrs old, no kids, never married...no dependents.
He wants me to claim 5-6 dependents...so my take home pay is larger.
I don't feel great about this arrangement.

on a W-4 you claim withholding allowance, NOT dependents. It is NOT illegal to have an allowance greater than 1 even if it's just you. It all depends on your income and tax withholding that has happened so far this year.
You can go to an IRS website to estimate what you should put on your W-4:

It is possible that with the estimated payments you have already made, that claiming 5 or 6 could be proper for this time of year.

The IRS will allow you to claim 9 exemptions on your W4 without a reason. However, if you claim too many you will owe Federal and State tax on your tax return. If you are just starting now, (November), you can claim more since your income will only be for 2 months. Make sure you change it to 1 or 2 in January of 2009 |

Your employer is not allowed to give you tax advice. At least in my state it is illegal. It sounds like hes trying to do something shady. I would look into what the laws are in your state and figure out whats going on. |

On your W-4, it's allowances that you claim, not dependents. An allowance can be for a dependent, or for several other reasons, like other deductions and credits. You are allowed to claim the number that will let you come close to breaking even on withholding compared to what you'll owe. If that number is 1 or 2, as it most likely is in your case, then if you claim more that that you'll just end up owing when you file your return, plus owing additional for penalties for not having enough withheld. Don't do it. |

The good thing about this is that you will not have to pay self employment tax of 15.3 percent on your gross wages. You will only have to pay 7..65 percent,
Just be happy that you are working.
Allowances are not deductions, so he is not asking you do anything illegal. If he accepts your W-4 and it messes you up with taxes, you could have a claim against him in the future.
I would figure that if you claim 5 allowances , you will end up owing taxes. Ask him if he will pay your taxes if there is a balance due? |

This is a question about this question. Don't you have to give the SS# of the dependents that you claim on your W-2. If you just make up dependents what do you write there? |

The problem with claiming more dependents than what you have is because at the time when it comes to filing, you will have to pay in instead of getting a refund. |
