Is it legal?
ok i just interviewed for a new job and they said that they would pay cash but i would have to do my own taxes...like save some back each check cause i will have to pay when it comes tax time. is that legal?? and why would a company do that, like are they trying to get around something like paying me for social security????

i want to know cause this could be the decision whether i take the job or not.

Yes this is legal and very common. What they are going to do is call you a contract laborer and not an employee. Think of hiring a gardener, you don't give him a W-2 or pay in social security for him because he is not an employee... it's the same idea with this, and depending on the industry you are in is fairly common practice. I see it all the time. At the end of the year he will give you a 1099 instead of a W-2, because no tax is withheld you have to be responsible and pay in taxes over the year on your own. The drawback to being a contract labor instead of an employee is that you get slammed with paying twice the social security and medicare tax that you would as an employee. This is because employers are required to pay in 1/2 of their employees social security and medicare... so consider this when thinking over your salary. The social security and medicare put together will cost you 15.3% of your salary instead of 7.65% for an employee. So in a nut shell 7.65% times your salary is what they are saving by calling you a contract laborer instead of an employee.

They are hiring you as an independent contractor... They will send you a 1099 at the end of the year, as opposed to a w-2. You will need to claim that money on your schedule C. As an independent contractor, you will be responsible for paying your own taxes because they won't be withholding taxes.

it is legal but it is a royal pain in the butt. i wouldnt take the job just cuz it is such a pain to have to withhold it urself. they do it so it is less work on their part come tax time. good luck.

It's legal, just more paperwork on your part and less on theirs. Personally, unless the job is a huge leg up on the career ladder, it's not worth it.

I could be legal depending on all circumstances, but it could be illegal.

If they treat you as an employee by directing you how to do your work, when to do it and other factors, then you are an employee. The company does not have any choice in the matter of how you are treated. They can be subject to fines and penalties if they are supposed to treat you as an employee and they do not.

If your services are those of an independent contractor, then it's legal. If they exercise a lot of control over you... your hours, where you work, etc., then you would be an employee and they would be required to do withholding.
Some employers attempt to evade the employment taxes by telling employees what you were told. It truly is not their option. Employers who evade their obligations are facing big problems with both state and federal authorities once they become identified.

They are paying you as a subcontractor. Depending on the job it may or may not be legal for them. They are doing it to advoid social security and insurance. Check it out carefully. Note that you will be required to pay double social security, yours and what the company normally pays.

some businesses do that, my brother in law has his own business and all he is required to do is give a form showing what their wages for the year was they have to deal with their own taxes at the end of year, there is a special form the business owner sends out showing the wages.
