Is it legal for a company to break into your house and take your things because you're behind on council tax?
We are behind a few months on council tax - we don't qualify for any discounts even though my wife is on Incapacity Benefit and I have a low-income part time job and we have two children under the age of 3.
We make payments when we can, and as much as we can, but they don't give a crap.

Some debt collection company has sent us a letter saying they will come round and take things even in our absence. Is this legal?

no they cannot break into your home in your absence so don't worry just do what everybody else does pay when you can and don't answer your door

Get legal advise now!!! Go to the CAB or phone them!! I think they HAVE to apply to a Magistrates Court to apply for legal entry into your property. You and your family should not be under this amount of emotional stress with a threat of collecting from you. if you are able to pay a small amount to them on a reduced payment scheme then I think legally you are within your rights to refuse entry because you ARE paying! Check it out son!! get there today don't waste time on here!!!

Yes, I'm afraid it now is legal, although I am not sure about the legality of the council tax itself, it is demanding money with menace, we seem to be paying for the same things over and over again.

i think they can but you really should contact the citizen advice they will hopefully be able to help

Im not too sure but they would take you to court before thye done this and if the sheriff saw that you were making payments when you could it will prob be thrown out

The bailers are allowed to enter your house and take property, if they have served you with legally binding notification. But at that point the property is not yours, it is sold at a small price to repay your debts.
If you have little capital, and a low income, you should be entitled to council tax benefit, currently you need to give evidence of your capital and income.

If the house is yours, it is not counted as capital while you live in it.

its illegal, call the police and then the council tax to get it sorted out as you should get rebate for incapacity benefit and low income etc

I didn't think they could just break-in entry, scumbags, go to your nearest citizens advice and get as much info as you can, I think they would need a court order first, just in case hide all your valuables.

No they can't do this without a warrant of entry, but sometimes they find an open door.............

go to your local council TODAY if your wife is getting incap ben or you are recieving tax credits you may qualify but go today dont ring go in person with the letter that you have recieved

yes they are shits i would put all your valuable stuff in a friends house or move they bring the police with them an they need a warrant .

NO NO its not they are not allowed to break in do not let them in if they come round put the chain when you go out make sure your windows are closed for every time they come round they will put extra chages on top of your bill on if you have one seek some legal advice you will have to pay your council tax no matter what have you applyed for working tax credit and child tax do so if you havent go and see the council tax set up an affordable payment plan if these people are already writing to you dont ignore them research your rights and entitlements C.A.B is a good starting point also your local MP is somtimes a good person to go and see
