Is it legal for a married couple to file taxes separately and claim 1 child each of 2 children?

angie
no i think that if you are married you have to file joint taxes.

Yes I would say you can do that but it will cost you more money as you both will pay a higher rate of base taxes,it is almost always better to file together.....

garrygeorgemorris
Yes it is legal to file separately and claim one child each. It's better to file jointly the check is much bigger.

I dont think it would be to your advantage to do that ... better tax credits come for married jointly and with the total dependants. That may be different for divorced people. You should get a program like Turbo Tax and figure out each possible way for getting the most money back. I am pretty sure it's legal (call the IRS) but I don't think you'll want to after you see the results.

its not to your advantage to file in that fashion. Married filing jointly offers the best tax breaks you could possibly get especially on your child income credit.

Yes, it's legal, but will almost certainly cost you more in taxes.

If you're thinking that by filing separately, one or both of you will get an Earned Income Credit, you can't get the EIC if you file separately (married filing separately - since you're married, you are not allowed to file as single).

Yes, it is legal. Filing status would be Married, filing separately. It is ok for each parent to claim one child. There are some restricitions. For instance, if one itemizes, they both must itemize. Certain credits are lost when filing separately.

Almost always, a couple is financially better off filing jointly.

barrbou214
it is legal but why? the family would stand to lose at least a grand and a half in refunds. file married filing jointly and two dependents
as well as any other deductions. just to let you know if you follow the course of one parent one child each this year and decide not to do it next year you may get flagged and be called in for an
audit which is not pleasant.

firewomen
You can file seperatly but it will cost you more money to do that.
