Is it legal for a person to state in their will that taxes expense, bill etc be paid before assets distributed
I am named executor and will states assets divided on a percentage basis after taxes etc paid.
One heir, a registered charity, claims they should get their percentage share before taxes. I know deceased wanted all taxes paid then assets shared.
Anyone got a legal answer, not the usual looking a gift horse in the mouth one.

If you are in the UK, all debts (and that includes taxes) have to be paid before estate can be distributed. If for some reason this wasn't done, could come back on beneficiaries. I know that where percentage portions of estates are left to charities, those charities can make life very awkward for executor. If you don't settle within a year of probate (for example, where a property has to be sold), the charity can claim so much interest on the amount due to them to come out of the rest of the estate in addition to the bequest. The large charities monitor probates, as done, to ensure they don't miss out on anything, and they sometimes have solicitors on staff, as employees, so that claims can be pursued. I think the answer to your query will depend on exact wording of will, this doesn't always reflect what deceased intended. This can be tricky, I think you should consult a solicitor to help with probate.
The part of estate left to charity will not incur inheritance tax.

If a bequest is made to a registered charity in the UK, that bequest is exempt from IHT and does not form part of the estate for IHT purposes. This means that the bequest is paid without any deductions.
All other bequests are paid from the net estate(after IHT)

You have a complete and utter duty as the executor to carry out the wishes of the testator to the letter and to the best of your ability. Only a court of law can vary these conditions. If you need confirmation you should contact a solicitor and the cost of this will be borne by the deceased's estate.

Taxes are paid by the executor on behalf of the estate, from the accumulated assets. Beneficiaries are not normally liable for tax on their inheritance. Distribution cannot take place without the payment of any tax or debts due.

It depends on what Country the deceased was resident in as to which rules of law apply.

You need to look up the Administration of Estates Act 1925 for the answer in the uk.
