They need a seizement (liability) order against you issued from a court before they can access your land a seize anything. they certainly wouldn't get an order after one missed payment. You need to miss two payments before they can take any action yet alone apply to a court.
You would also have to be summoned to court.
Write to your council asking them to explain the leagl basis this was carried out under. Go to your local councilor about this and complain to the local authority ombudsman
sounds like an over zealous council have broken the law; seek damages

This does not sound right at all, especially if it's just one payment.
The council pass their outstanding debts to debt collectors, who are almost certainly are the ones who have clamped your car. Don't try and take the clamp off. Instead photograph it. Book a taxi if need be for work, or get a lift, and then contact Citizens Advice Bureau in the morning. Tell them what s happened, and they will suggest a course of action for you.
(Get receipts if you use taxis. ) Good luck. |

get legal help now, its possible they broke the rules but you do need proper legal advice.
This reminds me of the couple who came home from holiday to believe they had been burgled, and it turned out British Gas had entered their property, with the aid the council i might add to turn off the gas meter, because BG believed they owed money, which they didn't. Now if i had been them i would have sued BG for trespass and the council for same.
I suggest that this is quite similar. |

i have had a few people at work that ended up with an attachment of earnings order for not paying the council tax. but to be honest the amount they have owed has been in the hundreds not one missed payment. these have been ordered after court proceedings and the amount owed has gone back to previous years not present year. I dont think the action taken is legal - they should have given you further options to get up to date. we have all paid one month late for lots of different reasons but i have NEVER heard of this before. seek advice as to what you should do or contact your local paper, but most certainly complain loudly. |

I would think they are quite within their rights. Mind you. it would never have happened in the 60s when we were a free country. I remember when I could not afford my rates for a few months and the council just wrote if off. However this is 2008 and Big Brother is here to stay! |

It''s quite legal and the council will have gone through the process as per the Council Tax ( Administration and Enforcement) Regulations 1992.
For this to have happened the Council must have had a Liability Order issued by the local Magistrates Court and have instructed a bailiff to recover the debt. The bailiff can then levy on goods to recover this.
A court summons can be issued quite easily after 1 missed payment and often is. There is no requirement to be in arrears by 2 months or more.
If a Council Tax payment is missed then a reminder is issued giving 7 days to make the payment, if this this is not made within the requested time then a Court Summons is issued asking for full payment by the court date. Failure to do so results in the Liability Order + costs.
Taking the law to the full most interpretation means that even if you pay the amount requested on reminder and it isn't done so by the date shown then a summons can still be issued as the legal notice was not fully complied with. |
