There are hundreds of wolves and bottom-feeders out there offering holiday loans at interest rates starting at 30% and going up to 300%. Don't fall for them.

You cannot, in theory, file a tax return before Jan. 1, 2007 because your status is not fixed until then. This is true even if you file a "short year" tax return by reason of bankruptcy or death. Some people doubtless do: but they do not rely on anyone else for W-2s, 1098s, 1099s, etc. Some may print their own W-2s and K-1s because they run their own businesses.

But the IRS won't act on the return anyway until the first business day in January.

You could print a "substitute W-2" but you are not officially allowed to do that until February, and then only if your employer fails to give you one (typically because it's out of business and gone away); there's an official IRS procedure. Again, some people engage in "self-help" but if you make a mistake in the numbers there can be bad consequences.

Your only option is to borrow money and pay it back with your refund. You cannot file until the present year is over because there is the possibility that you could still recieve income in this year and the government wants their share.

No you can't file early. There are documents that you receive all throughout the month of January that you need to file your return. Employers and banks have until January 31 to get you the forms you need.

H&R Block is offering a loan against your tax refund. Currently the maximum amount is $1500 but if you can wait until Dec 27, some offices will be open and offering a maximum of $2500. You may not be approved for the entire amount, but even some money will help you until you get your W2. You can only apply once, so make sure that you wait until the 27th if you will need more than the $1500. And H&R Block is not charging any fees to apply (but the bank does have a finance charge), so even if the loan isn't approved, it won't cost you anything to try. If approved, you will walk out with the money.

Also, when you do get your W2, H&R Block has a guaranteed Instant Refund Anticipation Loan (Rapid Refund) so that you are guaranteed to walk out with at least part of your refund or your tax preparation fees are free.

As a side note, you should apply for unemployment whether you think you will get it or not. And the sooner the better since there is a waiting period before they start paying, but it doesn't start until you apply. You can apply online. It's really easy. If the company fights it, you can too. Many people get too depressed to fight, but it is worth it. That also won't cost you anything.

I hope things start looking up for you soon. It really is true that when one door shuts, another opens. There is another job waiting for you. You just have to find it.

Technicallly you could, but employers don't give w-2's until January at the earliest.
