As long as you file the proper forms, withhold the proper taxes and pay the proper unemployment premiums to the state, cash is fine. If you don't plan on doing any of that, then it becomes illegal regardless of whether you pay them in cash, check, money order, or barter goods.

It is legal to pay anyone in any state in cash. You just have to document it.

yes - but be careful about tax ramifications. you'll either have to make and disclose deduction or work with contractors instead of employees - and 1099 them.

Yes it's possible. Just make sure you keep a record of how much you pay out, and on what dates. That way you can properly declare them on your taxes. I don't know about New Jersey, but in Virginia, I think you can deduct salaries for your business.

You can't report paying a person with cash for "under the table" work. haha that's funny, maybe if you get them to fill out w-2s but you have a lot more paperwork then. 1099s might work too.

You also need to withhold taxes and make sure that there is some sort of payment voucher. You also have to take into consideration insurances I think... like workplace insurance. Say someone gets injured on site, then you are responsible possibly for payment of medical bills and such.

Honestly, your best bet is to contact the Department of Labor and Workforce Development of New Jersey.
