For future tips, file MFJ or MFS. By choosing single you are paying to much for taxes (YIKES). You can still put your maiden name on the return, as long as it matches your ss#.

FYI-I have been married for YEARRRRRRRRRRS :) and my ss# still shows my maiden name. I remember when we first got married, I filed with my married name-wasn't thinking-it got kicked back by the IRS, b/c my ss# and last name didn't match. I called and told them that that was the only thing I hadn't changed, and they informed me to just put the info as it appears on your ss card.

Be aware that they MAY flag your account next year, but you can simply explain to them WHY you did it incorrectly.

It is fraud to file as single if you are married regardless of your name.

If you have children and fraudulently claim the Earned Income Credit by filing as unmarried then you have a potentially serious problem with the IRS.

You can file only as Married Filing Jointly or Married Filing Separately unless you have an alien spouse.

If you are married, you should have filed as "Married Filing filing Separately". If you filed as "Single" and have not previously filed a "Married Filing Jointly Return", it is highly unlikely that the IRS will know the difference, unless, you notified the Social Security Administration that you are now married.
If this is the case, I don't think that you will be jailed, but your tax return may be questioned and then you will have to offer an explanation.
On the brighter side however, it is not too late to file an amended return using form 1040X, in which case, any problem that you may incur will be minimized.

yes, because just because you did not change your name, it does not mean that you are still single. You and your husbands names do not have to match on your 1040.

Yes it's illegal. If you are married, your legal options are a joint return, or married filing separately. You would need to amend your return to correct it.

Your valid filing options were married filing jointly (MFJ) and married filing separately (MFS).

MFS is often the same tax as single, but doesn't support some credits nor EIC.

And no, you can't say you filed as single because you didn't change your name. The IRS doesn't care about your name, it cares about your filing status.

Yes. You need to file based on what your tax status actually is. The IRS bases everything on Social Security number, not name, and they *do* understand that people often change their name when they marry, so the fact that your tax documents were in your maiden name wouldn't matter a bit.

In addition, you will owe quite a bit less tax by filing properly, as married, rather than both of you filing illegally, as single -- so it will definitely be to your benefit to file an amended return reflecting your actual tax status.
