Is it true your employer must give you your W-2 by Jan 31?
If so, what happens if they don't?

Your W-2 must be postmarked (if mailed) by 01/31 or handed to you (if given to you in person) by 01/31.

If your employer fails to comply with Federal (USA) regulations, the government can fine them.

kevin h
No, it is true that they must have mailed your w-2 by January 31st. If not, they could be penalized, but most of the time the IRS doesn't even know it happened.

The W-2's have to be post-marked by Jan. 31st. You may not get it until Feb. but as long as it was in the mail by the 31st they're okay. I know this because I asked my employer the same thing not too long ago. I don't know what happens if they don't. I'm guessing the IRS will penalize them, but I don't know for sure.

LMT in training!
NO. That is a very common mistake people make. It has to be POSTMARKED by the 31st. So you should get it by the following week.

yes, they have to have it mailed out by jan 31.. if they havnt done it yet, i would cntact the employer directly and if they dont send it after that, you can report it and they will be penalized.

Yes it must be postmarked or given to you by jan 31

T J
They are required by Federal law to do so to allow you time to prepare your tax returns by the deadline for them.Make sure that they have your correct contact information, because that's where they will send it to.

Technically- it has to be post marked by 1/31/XX. If not, then they get penalized. This is different from you having it in your hand by 1/31/XX.

They have to be postmarked by Jan 31st or they will be penalized.

Mustang Rosie
Yep, it's true. If it's mailed to you, it has to be postmarked by Jan 31, 08. It's a federal offense if they do not!

dreamguy74
it must be mailed by the Jan 31st it can take weeks to get to you as long as it was mailed.

i am not sure if that is true or not. i know that in most businesses, they have them in the mail by then.

i usually don't ask about the W-2 until around Feb 5. i figure that i am not the only employee and by that date they have time to process and mail them.

AlleY G
posted marked or they can be fined

Serge M
Yes, The law requires employers to provide the W2 by the end of January. Sometimes they get delayed in the mail, however.

Hey U, Yeah U..Get over here
they can be penalized by the IRS.

Yes, they are required by the law to send you the w-2 by Jan.31. If they do not comply, call the feds. They'll handle the employer.

Love A
yes r they'll get a penalty from the irs

DeeDee
yes it is true.

little_ruhe1
yes they get a fine i belive!

JeffyB
Yes, true.

bearjones87
I don't really know if there's any recourse to that, but yes, your employer is supposed to by law give your W-2 by January 31st.

I assume you can report them to the IRS, and they could fine them.
