Is my ex entitled to any of my working / child tax credits?
He pays no maitenance, and looks after our son 3 nights a week. He is saying that because i claim working / child tax credits for him that I should be supporting him when he looks after him? can he do this?

No. Child Tax Credit, working tax credit and child benefit are paid to the Parent with Care of the child. That is you. He is the Non Resident Parent, he can't claim these. The child payments are for the care of the child and payments are made to you as the main carer. What you then do with the money is a matter for you alone.

I don't think he can do this but it is an interesting point as you have almost got equal shared custody. He pays 3/7 of the costs and you pay 4/7 already which is as close to 50:50 as it gets.

If he is working the CSA would actually make him pay maintenance for the 4 nights out of 7 you have your son. If it was a little fairer you should then be paying him for the 3 nights out of 7 he looks after him. Which of course would be ridiculous but it is incredible how much it is skewed because you have him for an extra day.

I can also see his point about the working/child tax credits as the reason you get them is for your son. But it doesn't work like that.

I'd be thankful the way it works is so unfairly skewed in your favour!

No he has no right to anything, take him through the CSA and get maintenance from him, they will deduct the 3 nights a week your child spend with him from the money he owes to you. He can't take any money from your working/child tax credit nor from anywhere else, if he presists tell him he needs to pay you for the 4 nights a week he stays with you, he'll shut up pretty quickly! He's a father not a babysitter, he should enjoy the time he has with his son for the right reasons. Not because he thinks it will earn him some extra money!

hes trying it on , i use to be in your position where my x had my kids whilst i worked an it was a nightmare.because he looked after my kids he was forever trying to still control my life an interfering, he knew i was relying on him and took advantage of the situation. my advice would be do what i did and regain control by being independent, i stopped working for a while and it was the best thing ive ever done, he still see the kids and i dont have any problems with him anymore.

The money is provided by the tax payer and goes on the child not you two.

People get very confused about these two!

Working tax credit is paid to the person who works so he can't ask you anything from it! The child tax credit is paid to the person who mainly looks after the child even if the children don't live with that person. You also get the child benefit which is paid regardless of your situation.

My 3 children live with my ex but I look after them every day, do the school run etc and work too. I claim both and he does not paying me any maintenance either. If your ex wants you to support him then tell him that he has to pay you maintenance. He hasn't got any rights on your claim. Alternatively you can both make a separate claim and let the working/child office decide who gets what.
