A friend of mine is 19 (turned 19 in March, so 18 when taxes were filed), lives with her parents, and goes to college as an undergrad student. She doesn't pay rent or help pay for food. The college stuff is in her name, but her parents are the ones putting the money into the accounts. She told me she made over $6000 in the tax year, so she did have to file, but she told me she filed as an independent so she could receive a stimulus check. I explained to her that since she doesn't pay rent, for food, her parents give her money for transportation every week ($40+/week for gas to get to school and back home), her parents pay for her insurance through their work programs, pay for her clothes, etc., then they definitely pay over half of her support and she does not. My question is, am I right in saying that she should have filed as dependent and her parents should have claimed her? Most of the money she DID earn was spent on going out with friends, getting tattoos, and so on, not support. Additional Details Excuse me, but it IS my business when she starts talking to me about it, thanks :)
And yes.. she's over 18 but the requirement is she has to be 19+ AND provide over half of her support. Support isn't tattoos and going out with friends.. support is food, housing, clothing, transportation, etc. She's not providing that for herself, so how is she an independent? You have to provide for yourself to be considered an independent (at least over half of your support). That's what I'm trying to say.. she's not providing that for herself, her parents are. |

If she's a full time student, it sounds like her parents have the right to claim her as a dependent. But if they didn't, and she claimed herself, it will most likely slide by even though technically she isn't allowed to claim herself if her parents CAN claim her, even if rhey don't.. |

That really should have been up to her parents. You never know... maybe the taxes worked out so they got more back if they didn't claim her and her expenses. Maybe the bottom line made sense.
So, bottom line, it's really none of your business...it's between your friend, her parents, and Uncle Sam. |

As an Accounting major, I know its up to her parents. If he parents claim her as a dependant on their taxes, she will not recieve the check. If they didnt claim her, then she would. |

It would have been up to her parents. If they wanted to claim her they could have. She could have also have filed and checked the box that says claimed by someone else. If her parents didn't have a problem with her filing her income taxes then I think it is OK. It sounds like it would have helped her parents more if she would have let them claim her, but then again they may make a lot of money and it didn't matter. Its her and the IRS business not yours so who cares how she filed. |

Since she was 18, if she and her parents agreed to let her file as single, then it's fine for her to do that. The money she filed was wiped out with her filing status and personal exemption, so it doesn't make any difference. Depending on how much money her parents made, the only thing it could have done was to reduce their taxable income by the additional dependent exemption they would have received, plus any tuition paid on her school loans may have netted them a credit on their taxes. She's not filing head of household, so she's not required to pay more than half for everything - that is really a moot point :) It doesn't matter what she spent the money on either - it's money her parents gave her to spend as she saw fit. |

She's over 18, earning her own money (regardless of what she's spent it on--that's between her and her parents) and meets the requirements. So, she is correct in filing on her own and getting her own stimulus payment. If her parents had claimed her (and I'm not so sure they could have) they would not have recieved the extra money for her because she is over 17. |

The IRS would view this as a facts and circumstances issue. So will FASFA.
There is a worksheet in IRS publication 501 for determining if the support test was met.
In order for someone who was 18 to *not* be claimed as a dependent, they had to provide more than half of their own support. Your friend would have to show that her total support was less than $12,000, so her $6000 of income would count as more than half. If she didn't provide more than half of her own support, even if her parents didn't claim her, she couldn't.
She doesn't pay rent, but her share of the housing, utilities and food *is* considered part of her support and since she didn't pay for it, it's support provided by her parents.
You don't mention how her tuition is being paid. If she got loans and she is personally responsible for paying them back, that counts as support she provided herself. |

She was wise to file as Head of Household-independant as you call it. Regardless of the actual situation, all that matters is that her parents agree to it and don't claim her as a dependant at the same time.The IRS will be on it and someone i'm guessing the parents will have to pay back what she got. Ultimately though it is a choice between her and her parents-and if they are OK with it and want her to get some xtra cash so be it! And since you asked...I actually think you're wrong in butting in- it's none of your business. It just makes you look jealous. Either way she is entitled to something-Afterall she did work..didn't she? : ) By the way I use to work for a Tax Office when I was 20. |

Well since she is over 18 i guess she can file independent. However I did not do that (Im 19) because i was in the same living situation as her. I live with my parents, I am under their health insurance, and I am def a dependent because of issues like that. If I was to claim myself as an independent I would have gotten the stimulus check but would not be a dependent anymore. So I would not have health insurance or a house to live in. SO I think you are somewhat right about her claiming herself as a dependent. However, she could still claim her self to be an'independent', but in reality she is still dependent on her parents for basically everything. She's lucky to have parents that want to do that for her. She is probably eating out of their hands for as long as she can. |
