I'm about ready to. The first nim-rod I was grilled by didn't know the difference between an S Corp and a C Corp.(I have an S Corp). After I demanded that he bring somebody else in that knew something more than tieing their shoelaces, I was introduced to his supervisor. She spent most of the time staring blankly at my last 7 years tax filings and then ( and I'm not making this up) asked if I was set up as Sole Propriotership. After showing her the Letters of Incorporation and again the last 7 years tax filings, she said that she would have to consult her superior.
Now, anybody out there knows that an S Corp is about as simple as it gets.
How can these people be so stupid? Additional Details jp Welocome to the real world. There is no statute of limitations when it comes to taxes. |

Brother, I feel so much for you now that I'd hug you even if you were a complete stranger.
They have no accountabily, and when they get their claws into you, they make your life a living hell.
The reality is IRS auditors are generally low end accountants that could never make it in the real world. I've always had the best luck with my business' using the most expensive local firm to do my taxes, and when audited, I get them to deal with Revenue Canada (same as IRS.)
These guys are good looking, alpha types that wear $2000.00 suits and they intimidate the socially dysfunctional IRS agents. The better looking you are, or the better looking representation you have, the more likely chances you have to succeed.
Thats why you know your best looking sales people make the most sales (on average.)
Good luck brother, and believe me, I've also felt the urge to pay a few people to break some legs, but in the end it ain't worth it. |

As it is... there is no statue of limitations relating to taxes when FRAUD is involved so perhaps you must provide additional detail. I find it difficult to believe that your agent did not know the difference between a C corp and and S corp and find it more likely that your tax liability was in question. From your brief description, it sounds as if there was some confusion regarding the organizational structure of your company and it seems a simple thing to prove to the IRS with incorporation documents.
An an S corp... is not NEARLY as simple as it gets.. |

Egad, how frustrating for you. But it's terrific you have all your paperwork in order -- they're probably used to bullying people around who aren't equipped to defend themselves effectively.
I actually have a music colleague who's an accountant, and he worked for the IRS for about a year. He got burned out because there was just no way to keep up with everything in the tax code.
So keep going forward calmly and confidently -- it sounds quite obvious that you have the upper-hand here. Every time they try a lame-o ploy like the asinine questions you mentioned, you just keep immediately answering them and presenting the corroborating documentation. Hell, feel free to get just a TAD bit smug with them -- you know, smiling but giving a hint of attitude like, "How can you be such an idiot?" |

I think the question should be if these returns were filed timely, why are you allowing the IRS to look at 7 years? The statute of limitations has probably run on at least 3 of those years, if there isn't any sort of fraud involved. |

S corps are not treated the same in every state. In some states, an S corp is treated like any other corporation as far as tax liability goes. For this reason, it is important to seek professional advice before committing to setting up an S corp. So I hope you have a legal council that you seen when you set up this S corp, depending on the tax rules in your state you may be responsible for some taxes otherwise it is the responsibility of the owner. But I see your frustration the IRS agents and the supervisor should already know the rules this could be good or bad news for you. To save yourself some headaches I would contact a lawyer who is knowledgeable in the laws pertaining to this tax liability. Most will give you a free constilation. Or second go on line and look up the laws in your state and have them ready when the supervisors supervisor contacts you. CYA Cover Your A** |

Isn't it scary to think these people have your financial life in there hands ( the fines etc) good luck ring an ombudsman there is usually one around for every problem out there and they are a good help when you need answers. |
