Only way you can get refund/rebate money when there's been a past due child support offset claim made is to pay what you owe. You will not be able to receive a refund/rebate until the debt is caught up. If however you have a spouse they can receive their portion of the refund/rebate by filing the Injured Spouse form. |

While I do not know for sure, I would not be surprised if your tax refund slips through the cracks and you receive it directly. If you do receive it though, do the right thing and send it towards the back money due on your child support payments. |

Why would you keep your refund when you cannot support your children? (this is from an adult who never received support from her deadbeat dad as a child and my mom had to do without a lot of stuff to ensure that my brothers and I were taken care of) |

you have to be current on your child support to get your tax refund.
we had the same prob w/my fiances tax refund being taken bcse of an issue we are having w/the amt that the ex claims he owes for support. |

until your child support is paid in full though the courts. |

If there is a way, it would be through the Child Support Enforcement Office that handles your case. Neither the IRS nor Financial Management Services, which administers the offset program, can refuse to honor an offset request for back child support. |
