 I have just graduated from university and have a large student loan to pay off. Do i still have to pay tax? UK?

Is there a problem if i filed head of household on my 1040 by mistake?
Im married. Live with spouse. Own a house and have 2 kids. I filed head of household on my 1040 for the last 3 years. I did a mistake because now I understand what head of household really means. Im I in trouble with the IRS. What can I do. Should I just let it pass.

You can go back and file amended returns to possibly get back more of your withholdings for those years which you mistakenly filed as HOH- there is more of a break for jointly filing spouses than there is for HOH.


Since you've probably been hurting yourself and giving the IRS more money than you have to, you're not likely to be in any "trouble". Not knowing all of the details of your situation, there could be something else that would make me wrong, but you probably don't have anything to worry about. The best thing to do, either way, is to amend your returns. You'll probably end up with more cash in your pocket, and you can be assured you've done everything in your power to make your returns correct.

You need to amend your returns.

If your wife did not work, you would get more money back.

If she did work, you will probably owe some money.

You should not just "let it pass".

Yes, definite problems. You weren't eligible to file as HofH, so you need to amend your returns. It might result in more tax due, or additional refund, depending on your circumstances.

How did your spouse file? That might determine whether you owe more, or get more refunded. If your spouse didn't have income or didn't have enough to file, chances are that you cheated yourself out of swome of your refund.

Don't just let it pass. If you have more money coming back, then you'd be giving that up. If you owe, and they catch up to you later, then interest and penalties would continue to accumulate.

You can't let it pass. You MUST amend the improperly filed returns.

However it's not necessarily bad news as your tax liability will probably be LOWER on the amended joint returns than it was on the HoH returns, so for tax years 2005 through 2007 you'll be getting extra money back from the IRS in most cases.

You should amend your returns. most likely you will benefit from the change. The standard deduction for married is more than head of household.

No, you don't let it pass. This is an invalid return and if it got you a larger refund than you were entitled to, it's fraud.

You file a 1040x.

You can amend the tax returns to Married Filing Jointly. If your wife did not work (and has a valid SSN), this could result in an additional refund.

If your wife did work and filed on her own, you can still amend to MFJ (and should). It's a little trickier as you put your data as the starting point, the joint data as the ending point and then list both refunds. When it's processed the IRS will zero out her taxes for that year. If you both filed and managed to claim EIC, you could owe.

You must file amended tax return. If you are married you can only file as married filing jointly or married filing separately.
To be head of household, you should not be married or should not have lived with your spouse for last six months of the year.
How did your spouse file her tax return?
